Would love to see that in a court 9.4(z) is clearly a penalty charge which is illegalOne important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.0

£25 and (z) you will have to pay Seatwave 25% of the ticket value
This...?!0 -
Yes. That's a penalty as it is not a true cost. One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.0

You guys are absolute genuises...has anyone told you that...!?0

If they replace the tickets you'll pay £25 plus any costs they incur in sourcing other tickets. Obviously the price the buyer has paid (before fees) for your tickets will be deducted from this bill.
So, if the new tickets cost £100 and the buyer paid £50 for yours, you would be liable for £75.
This sounds pretty confusing to me...?!
So I would now have to pay for a new ticket plus, 25% of the old ticket and a charge of £25?!
That seems excessive?!
Where would the buyers money go to, who would receive that?!0 -
so I basically make the difference up and pay £25 ???!!
so for example.
sold tickets for £50 - which I think I have cancelled.
SW - then find replacement tickets for £75
I have to pay £25 differnce and £ 25 charge a total of £50.
Does this make sense?!0 -
You should also bear in mind that they have a duty to mitigate their losses. There are two contracts here. You and Seatwave, and Seatwave and the buyer.
If they were to truly mitigate their losses, then they simply refund the buyer and charge you just the admin. If they claim to source a more expensive ticket from elsewhere (which I believe they may well claim), then that is not mitigating their losses and you could sue to get your money backOne important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.0
