I told them that my husband dropped me at the airport to collect our visitor, then went off to another appointment. Our visitor was visibly unwell when I met her, (she had been off work as a nurse for 4 months0 I rang my husband to say it wasn't a good idea for visitor and I to get shuttle bus into town as planned as she was obviously not well. He returned to the airport we walked down past the roundabout for fresh air, he stopped (on record) 17 seconds. I asked for common sense to prevail as we are both retired people. I am not saying we didn't stop we certainly didn't park, we are both responsible people who acted in the best possible interest of our visitor, and caused no problem to the general publics safety.
Hopefully PoPLA will see that it's covered under the BPA grace period. However, it's mitigation, which they don't do. We are talking about money and profit, so common sense doesn't come into it I'm afraid to say. You will get a load more begging letters but that should be about it. Be thankful it isn't Parking Eye. Even if you do get court papers ( and I'm more likely to wake up next to Kelly Brook tomorrow and I can assure you I'm no looker ! ) then come back here to get a winnable defence. The whole process is designed to intimidate and bully - and please don't take this the wrong way - elderly people are probably the most taken in by it.
YOU owe them NOTHING so whatever you do don't worry !0 -
No offence taken I know what you mean, the older we get we are less able to take on hassle and feel intimidated by these people, with there photo,s and videos etc. how can they not make us pay when they are spending out
on their evidence. I wont be paying it, I will come back and attempt to follow the correct procedure. Thank you very much. Will the Ombudsman be able to help, what about the Liverpool Echo.:mad:0 -
The is no ombudsman, dont bother with the paper

You haven't received a rejection from PoPLA yet, so maybe common sense will prevail for once.
Even if you do, the decision is not legally binding. You may get some more junk mail from the PPC, but court papers are highly unlikely for this PPC.

He was being sarcastic, as you 'ignored' our advice...for Goodness sake read my suggestion below, you COULD still claw this back at POPLA (maybe). I gave you links to draft a decent wining POPLA appeal. What a shame, POPLA was your 'ombudsman' (effectively) and you didn't include anything I gave you links for, nor did you ask for help nor show us what you intended to send. Oh dear.
How about trying this?
Send further evidence (rebuttal of their signage evidence, saying there was no loss now you can see the words on the sign you realise that they were not compliant with the BPA CoP and the evidence pack shows nothing to prove any loss, seeing as the signs show their case is a 'breach of contract'). Say this has only become apparent now you have finally seen the PPC's 'evidence'. Add that as it was Airport Land, no registered keeper liability applies in your case anyway as it is not 'relevant land' under the Protection of Freedoms Act 2012 and as you were the passenger you are not liable either. Say that, in the interests of fairness you have sent VCS a copy of this reply as well and if POPLA thinks the best thing would be to postpone the decision to allow VCS to respond to this evidence against their 'evidence' then you agree that might be best.
Questions:
- did you send the appeal in your name (as passenger) or in your husband's name? Who is the registered keeper (whose name on the Notices they sent?)
- What evidence have they sent, please tell us about EVERY PAGE? Maps? Photos of what? Signage? What do the signs say in their pictures (exact words)?
Please reply to my queries, please talk to us and see if we can come up with something extra for you to send TOMORROW first class to both POPLA and VCS!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
