Well done indeed!I guess the moral of the story is that they can fob off your letters but they rolled over pretty quickly as soon as I went to court.
....After your LBA/ NBA notice has expired ....start court proceedings.Successfully sued Ryanair in 2013/14...and have been 'helping' litigants since then.

That is precisely the moral of the story: if you think you have a claim, start legal action (either under your own steam or with a NWNF lawyer). It is unfortunately the only language the airlines understand.0 -
I just want to say a big thank you to everyone on this site for all the information and advice. I just received an email from Virgin this morning advising me they making a bank transfer of €1225 to my bank account. :j:j
My son and I were passengers on this flight from Gatwick to Orlando which was delayed by 27 hours due to an oil leak in one the engines which led the whole engine needing replacing. Their spare plane was also not available due to damage by lightening the previous day!
I first made a claim in August 2013 which Virgin rejected due to "extraordinary circumstances". I complained to the CAA ( which was a waste of time) who asked Virgin to reconsider but still got nowhere.
In December 2013 I commenced proceedings in the small claims court from Dublin, Ireland. I received a letter from the small claims court approving my claim on the 31st December and this morning, the 07th January, I received the email from Virgin which said they did not admit liability but see no value in disputes of this nature with their passengers and would therefore like to settle it!!!
I'm so glad I didn't give up and found this site. I am just amazed how quickly they paid up!!

Received my payment today after 38 days.:j
However, it took me 12 days to collect all (4 families involved) the signed forms as I did not want to chance loosing any in the christmas post. I then hand delivered them to Botts office on 15th December.
Then it was the christmas break.
All in all I'm very happy with the result and think the time taken to receive payment was more than reasonable under the circumstances.Please read Vaubans superb guide. To find it Google and then download 'vaubans guide'.0 -

Most claims do seems to be stayed, but before that happened I think we firmly established on this thread that your chances of winning if you started legal action were about 90%.0 -
Well, just to be clear for others yet to embark on the journey, even if *your* case is likely to be stayed, it still MUST be commenced before 6 years are up.0
