Advice needed about a phones4U upgrade

Hi, phones4u have given me an upgrade. I haven't had the phone yet as they say i have to wait till may 18th which is 1 month early for the end of my 2 year o2 contract which ends June the 18th. I rang them to cancel it today saying i had had a change of circumstances and they are telling me i can't cancel it even though i have received nothing from them as it's an upgarde and they have given me a free month even though on the o2 website they say you can upgrade a month early for free.

  • I take it phones 4 U have rentered you into a new contract without your permission with o2 can you not just ring o2 direct customer services the contract is with o2 not phones 4 U I am with orange through phones for U and if this happens to me I will be straight onto customer services

    Phones 4 U are one of the worst companies to deal with so good luck.

    You can 100% cancel the upgrade because you ordered it over the phone and because you haven't signed for the goods.

    I sometimes wonder where people dream up such misconceptions.

    Why is it misconception?
    If the OP really has to wait until May 18 for the new contract to start, i.e. has not used any services under the new contract yet, then I don't see any reasons for DSR not to apply.

    The OP can return the upgrade because the service hasn't started yet.
    -There is always a cooling off period via DSR
    -She hasn't signed for the package at the door (even if she did she could still return it)

    You went wrong by mentioning the phone that has not been delivered yet.
    What really matters is the services that have not started yet - regardless of the phone. Started services is usually the main reason why DSR don't apply to most upgrades.

    ok fine. But services don't start until next month when the phone will be delivered. And even if the phone is delivered the OP can still return it.

    The DSR does not apply to upgrades.

    Most company's extend it so the same policy applies to new sales and upgrades, P4U do not. As you said not a great company to deal with when it comes to upgrades.
