Any problems with the headphone jack can be circumvented using a Fiio E1 amp (with volume controls).
I think I paid £8 for mine.
That's looking like my best option at the moment, to be honest (even if I can't find it that cheap!).
I was thinking about taking it to the market like LimeLight said, but if they open the case it invalidates the warranty so I have to decide whether or not I'm going to continue with Apple route or just have it fixed myself.
Epiphone - if I do send this snail mail complaint and they don't reply, I think that might be my next step.0 -
What warranty? Isn't that the crux of your problem - Apple are saying you don't HAVE a warranty any more?

If I'm going to continue with the Apple route and attempt to get them to fix it, I can't have someone opening the case and poking around inside it or they'll just use that as another excuse not to fix my iPod.0 -
I wonder if you could argue that the discount was a "partial refund", and therefore the replacement should be treated as a new purchase.
Alternatively, you could try to argue that it was a chargeable repair (for which they repaired by giving you a refurb model) and that the repair should be covered under SOGA too0 -
Gah - I tried to get the repair shop in town to do a report to send to Apple to prove that I hadn't damaged to headphone jack ("After this (six months), the burden of proof shifts and it's up to you to prove they were faulty when you bought them"). The only way to get that report is to open the case, breaking any warranty I was trying to prove that I had.
The cheapest I've found in town to replace the headphone jack is £45. I'm sure I can find it cheaper but I think I'm going to have to buy an amplifier and just learn to live with it to be honest.0 -
You have legal rights under Sale of Goods Act (SOGA). Warranty is on top of your legal rights so Apple can state anything they want in the terms and conditions of the warranty but they cannot take away your statutory rights.
Get a report done by that shop and send the report to Apple.0 -

Just in order to clarify so I don’t end up making a mug of myself - the warranty is on top of SOGA, so even if I have the case opened and invalidate the warranty it’s not the end of the world because I’m enforcing SOGA?0 -

Correct.
A company can put any restrictions they like on a warranty but they cannot vary your rights under the sale of goods act.
That does not mean you have carte blanche to damage a good in an attempt to repair it and still retain the same rights as you would had you not touched it, but it does mean that it would be for the seller to prove that you were responsible for the damage, whereas with a warranty the simple act of breaking a seal or opening a cover could invalidate if those were the stated terms.There are two types of people in the world: Those that can extrapolate information.0 -

Yes, people keep telling me this - but I know what I'm like and to be honest I'd rather have it in the condition that it's in now than the state I'll no doubt leave it in if I attempt a repair.
I'm having the iPod opened so that a shop in town can write a report for me to send to Apple. I'll keep you all updated.
