    Sorry it went so badly for you.

    Your next step is to send them a 'letter before action', informing them of the reason why you believe they are in breach of the SOGA and that unless they make a satisfactory offer you will initiate proceeding in the small claims court.

    ETA: Remember a warranty is awlays in addition to your rights under the SOGA.

    The SOGA applies to second hand and refurbished goods in just the same way as it applies to new ones.

    It's also worth noting that you could have signed anything you like, but Apple cannot legally use this as an argument as you cannot sign your rights away...

    Out of interest, what was the price difference between a refurbished device and a brand new one (of three same model if still in production)

    It's hard to say, really. I had an 80gb iPod first, but when that one bit the dust they had to upgrade me to a 160gb version as they'd stopped making the 80gb. At the time I believe they were around £150? But after a quick search now I can find one at about £107.

    Upon reflection I should really have paid the extra £70 or however much it was - it might have saved me all this in the long run.

    Thank you to everyone else for their advice. I'm in the middle of drafting a letter now, so it's all been very helpful.

    BoosHaus, what exactly is wrong with the iPod?
    I just ask because my iPhone had a problem with the headphone socket, it turned out it just needed cleaning. I guess they would have suggested that at the shop if it was the same problem though.

    You've just reminded me - they didn't even look at my iPod! Last time when I had an issue with my iPhone (turned out to by a little bit of tissue that had become stuck - d'oh!) they took it and cleaned it out with what looked like dentist equipment. No such luck this time.

    I had a look myself with a penlight and a magnifying glass (unfortunately the best I can do...) and I can't actually see anything stuck or clogging anything up. Apparently the most common fault with these models is the prongs in the jack bending or snapping and not making a full connection with the jack. This seems to be the issue because I can get both "ears" to play if I jiggle them around a little or hold them in one place. I'm obviously scared to do any more than that for fear that it will stop playing all together!

    I couldn't see anything in the headphone jack in mine, but I saw a solution online so tried it out - sucking the dust/dirt out, and it worked! I don't know if it triggers the moisture sensor though.

    If that doesn't work and you get no luck with Apple, you can always just repair it yourself - the parts (I googled "160gb ipod classic headphone jack") cost £5 and there are lots of videos showing you exactly what to do. Or I bet you can find a phone repair shop to do it for you, for a lot less than Apple charge.

    I might still be tempted to point out that by their model, would a full price 160GB player be expected to last 180 days, twice as long as the refurbished model (90 days)? It's a slight deliberate misunderstanding, but it makes a point, and see what the head office think?

    If it's any comfort, you don't seem to be alone, Apple seem to be losing customers through lack of innovation at the moment, and there being some excellent alternatives.

    Yeah - they only made about $6.2b profit in the last quarter, down $1.2b from the same quarter last year. And $6.2b was still higher than the analysts had forecast.

    Life is so hard for Apple. :)

    Yes, but their problem is that investors are dumping them. Hence the very rapidly descending stock price.

    Of course that was the fault of the investors for overvaluing them in the first place.
