the rate for the loan in dec 2008 was 5.43

I wondered if they were saying that you didn't have three months where you didn't need to pay the ERC against the discounted svr loan because you were free to go anyway as you were no longer tied in to that part.

Otherwise I couldn't see why it wouldn't apply.

i think this is the point were it all makes sence the cap increase clearly increased the loan % but not the fixed the loan never had an erc its the fixed so with the cap increase triggering the three month gap on the loan the fixed is as i see it in the tandcs THE MONEY YOU OWE US too

i think i can see what you mean but in the paragraph i just wrote off there letter were it states i was affected all they have done is told me what i already knew its what they failed to tell everyone in 2008 that they have not mentioned
yes i could of left this part of my mortgage in 2008 and also in nov 2011 i was erc free but they are still failing to mention that i could of repaid all MONEY YOU OWE US
thats what the t&cs come across to me anyway

Exactly! You need to take the argument back to them. So far they have cherry picked the areas they are willing to discuss.
thats what i mean in the first part of the quote were it says this option was not available to customers with a fixed rate at this time
it still dosent say this optian wasnt available if it was svr linked does it things like this will throw alot of people off

    have a few of ideas
1 we need to see if all our letters are the same

    2 pull them apart

3 have a standard letter we send to them asking for more info

can we get a group started, some checking letters, some t&c , some drawing up letter to reply

only ideas please feel free to join in
