Parking Eye - help please

After reading all of the posts I must admit to being a little confused.

My daughter parked her car in a hotel space adjoining a fast food restaurant. The rest of the hotel car park was empty, ok she shouldn't have but.....

She duly spent 33 mins getting food and for her troubles has got a penalty charge from Parking Eye.

It is a free car park and with plenty of spaces there could have been no 'loss' so can we use that as a defence, if we need to. Also the notice to keeper (using anpr) doesn't say who the money is be claimed by... I.e. the creditor.

My view is to ignore and weather the storm of letters.....

Advice?

    If you are in Scotland you can safely ignore it. Otherwise, wait for Coupon-mad as she will keep you on the right track.

    What's the alleged 'contravention' then, is it an overstay? How long are cars 'allowed' to park there if using the Hotel?

  • Not an overstay, just being there. The hotel don't charge for parking but it is intended for hotel guests only, they make no charge for parking though.

    Technically I suppose you aren't allowed to park.

    And no, not in Scotland
  • Sorry cars can park there for as long as they like if they are at the hotel.

    I guess hotel guests would register their cars at reception but what about patrons who are not staying but just having a drink in the hotel bar? or meeting a guest?

    Yes I thought that must be the case - or why have a car park! But what does the fake PCN say is the 'contravention'? Parking without a permit, parking without authorisation? Wondering how PE (no staff on site, just a camera?) can tell unless it involves putting the car reg into a system at the Hotel front desk.

    Who is the registered keeper of the car, you? Your daughter? Company or lease hire firm? (= a problem). As long as it's you or your family member who is happy to ignore and 'weather the storm of letters' then enjoy!

    ...followed by a very strong POPLA appeal, heavy on contract law stuff and any BPA breaches by the PPC (not even mentioning what happened). POPLA do like the 'contract law arguments/unclear signs/unfair & unenforceable penalty/BPA Code of Practice breaches/PPC has no status, assignment of land rights or ownership/PPC has not shown the site agreement/contract' approach as is shown in some successful POPLA decisions so far:

    If you do ignore it then ignore ALL the PPC and debt collector letter chain except in the unlikely event of getting real small claim papers (not just a threat of same!). Keep all the correspondence filed (not binned).

    I am going to go into the hotel later and see what they do when I park up and enquire about a room or two, just to get the arguments straight.... In case it goes further.

    But we are looking at weathering the barrage.

    Yes my daughter is the registered keeper, on a PCP. Can we ignore the letters as never receiving them as nothing sent registered or recorded? :)

    That's a good plan to know the faults with the system. If you don't prompt them about your car being parked there, does the Hotel clearly remind you?

    Pick up a brochure while you are there, list of room rates or summat with no date on it (so not a printout from their PC). Put it with your paperwork in case it's useful later to have vague 'info of a visit to the Hotel where you weren't told to put the car reg in' and then just add each letter to the same file.

    If you are ignoring it all then yes you can do that; ignore debt collector (e.g. Roxburghe/Graham White/Debt Recovery Plus/Zenith) letters too. Keep them all together and laugh at them, don't bin them just in case because if ever the PPC did try a small claim you would NOT ignore real Court papers from Northampton (would be obvious and VERY rare, and defendable).

    Hi All
    I today recieved a Judgment for Claiment (in default) from Parking Eye Ltd/ Northampton County Court. I have taken the advice from nemerous forums to ignore everthing they throw at me but they just will not go away! Any advise on what I do now?
    I ignored the last letter from them with the Northampton CC details on it as it didn't look very official! I have recently lost my brothers wife (my sister in-law) and he is on chemotherapy for terminal cancer so could really do without this right now!

    I parked in the Starbucks/KFC Heathrow for about 20-30 mins too long (as did my brother in his car but he got nothing from PE Ltd) back in November last year.

    Please help me get rid of these bullies.

    ...and that was your downfall. This was NOT following advice from forums at all. We used to (still do) tell people to ignore all the debt collector letters - and only take seriously real Court papers. You ignored real Court papers when you could have defended it and won.

    Sorry to say, you will have to pay PE who must be laughing their heads off at default wins like your case. Not sure why you posted on this thread which is not about Court papers at all and should be left for the OP to update when they want advice.
