Can someone who is unemployed go bankrupt

Hi folks,

I did try to do a search before I started this thread but came up with very little.

This is not for me, I already went bankrupt and I would not be doing it again, thankfully I am totally and utterly debt free. But someone I know is in a tricky situation.

They have been told this morning they cannot go bankrupt as they are unemployed, this is the first I have ever heard of this, but rules could have changed and when I went bankrupt I was employed anyway so this problem never came up.

If someone could please advise me on this, then I can let the person know. I would not like to tell them they have been told a load of rubbish to then find out that you now cannot go BR if you have no job.

    Of course you can go BR if you are unemployed. Who told them that? I hope it wasn't someone who ought to have known what they were talking about?

    The only possible problem might be finding the fees to declare yourself BR, most people manage to find the money from somewhere though.

    I was told that if we had no income as I had lost my job and my wife is a housewife, any debts in her name she could not go BR as she has no income. add to that then I lose my job or it is not enough to pay existing bills then as I have no income and outgoing would exceed incomings I would naturally lose house but still would not be able to go bankrupt to start afresh. Even if I wanted to go onto benefits etc, We would be trapped by the debts and I would in that instance I think lose the children. This was someone that should know who was telling me all my options but when I said I would not be able to work told me that. I would end up in jail for CT and TV aswell probably there would be no way out. I think the thing messing it up is the house possibly

    Would you like to tell us who gave you this utter pile of rubbish please Ox, as if this is someone who should know better maybe a call from someone who does know better would stop them in their tracks, especially if said person is trying to get you to take another route, which they or their company may gain from!

    The debts in your wives name mean she will also have to go bankrupt, unless Fermi that has changed as well?

    I knew when you told me Ox this was nonsense but I then thought what if things had changed which is why I posted out here.

    Now you know it is rubbish.

    And Ox this has nothing to do with the house, that does not stop you going bankrupt, in fact houses are one of the reasons for people going bankrupt.

    Thanks Rossiereps I have no idea who has told him this, but I was positive it was not the case.

    I know he and his wife have to do it as individuals, and that they both have to pay the fee, but to tell him if he and his wife do not work they cannot go BR is utter rubbish.

    When I went into the IVA I can honestly say the woman met me in a car park for the meeting, at a petrol station. She went through everything and totally skimmed over BR, and I mean skimmed over it, had I known about this site in 2005 I would never have gone into an IVA. So I know these people can be unscrupulous, or bend the truth, or not tell it quite as it is, especially when their company are going to make shed loads of money out of it.

  • I wouldnt be quick to assume that it was a company that told the OP this, just as likely to be a charity in my experience?
