Mental health and sequestration

Hi there, I was diagnosed with borderline personality disorder and anxiety disorder a few years ago (I'm now 32) and after running my own business I had to go through sequestration due to the huge debts associated with it. I am back in full time employment and it took me a long time to get their but this year I have been going through intensive therapy and its made me highly unstable. I have already been signed off 2 weeks this year and it felt like the hardest thing in the world returning to work. I am off again today and I feel like this is going to continue for the foreseeable future.

What worries me more than anything is that I really don't have it in me to continue working in my well paid job anymore, to pay my monthly sequestration, My rent and bills...I'm at rock bottom once again. I know if I stop paying this back the sequestration fails and I'm back to where I was, it's a vicious cycle.

I just wondered if anyone else has experienced this?

    Morning and chin up Loupy, you cannot help feeling ill, so take it easy and rest firstly.

    Okay are you in Scotland, as I did not recognise the word sequestration, and looked it up on google, it is our word I think for bankruptcy is that right, or is this like an IVA as you say it will fail, here bankruptcy cannot fail it is final.

    So just a bit confused if you can explain a little more I will try to help if I can.

  • Yes it's the Scottish version of bankruptcy so exactly the same I think, set amount each month repayable for 3 years, discharged after a year (I'm 7 months in)...

    I'm so worried as I'm the main breadwinner in the household (my boyfriend doesn't earn enough to support both of us). I feel utterly trapped because I can't afford to take time off to make myself better :(

    Can I just say, with respect, that saying "chin up" to someone suffering mental health distress is possibly one of the worst things you can say. I know you probably meant no harm but just felt I need to point it out.

    I am sincerely sorry I did not know that, I will not do it again.

    I have a daughter with mental health problems caused by an illness and I often say it to her, I will not say it to her again either.

  • I'm fine with that term, I just really need some advice on what to do, whether I can take some sort of break from my sequestration, I'd imagine they only let me off without paying a month or so... I just don't know what to do :(

    I am not sure what happens if the amount you are paying each month for 3 years fails due to ill health, I hope someone else here does know but I will now go and try to google it and find out.

    Surely if circumstances change the order has to be changed in what you are paying, or does it just fail and you are not longer bankrupt.

    I did go bankrupt, but there was no money even though working, but part time due to ill health for me to pay, so it was a straight forward bankruptcy.

    Do you get sick pay?

    If your circumstances change just inform the official reciever (or equivelant) and have them re-adjust your payment accordingly. You might even end up at a point where no payment at all has to be made.


    I am not sure if you choosing to leave your job has any influence on the outcome though, can anybody confirm?

    As far as I'm aware, an IPA in Scotland should be varied downwards or even set at £0 if your circumstances have changed?

    Have you discussed your circumstances with your trustee?

  • Thanks all, I'll speak to my relationship manager and get back to this thread so people can see for future reference. Just got off the phone with my works HR manager and all I can say is there really is a stigma attached to mental health and I feel 1000000x worse :(

    Hi Loupy,

    I am really sorry to hear about your HR department they should be ashamed of themselves. I get very annoyed about this type of thing, and can only say that if you need to chat feel free to pm me.

    I hope your relationship manager can give you some advice. Can I just say maybe you should see your GP do you get sick certificates like in England, as maybe one sent off to your HR manager would be a good idea. It may also help with the other matter as you can then tell your relationship manager you are not fit to be in work right now.
