I started my claim for bank charges back in the beging of the year, a total of £3050 over six years.

only now iam being hammered for much higher charges (£150.65 in the last 27 days!) as barclays has now introduced a new charge for a reserve.

Would i be able to add these to my claim? as obviously the first claims (six years ago) were only £20 per time, but i'd much rather claim 6 years from now! with these new charges.

Yes, just keep adding them all on and remind them.
When Barclays finally paid up and sent me a letter i called and said there were a number of other charges to be added and was told to simply amend the form to the correct amount and fax it back.
    I got every penny:D

the Barclays reserve charges (to which I assume you are referring) have been introduced to create a 'service' charge as opposed to a 'default' charge. At the moment it isn't reclaimable although any £8 charges may still be, but i suspect any cap will be about that marker. The OFT are currently looking at Barclays new fees and I would hope they will be bought up in the test case and the situation clarified. For the moment though you must treat them as not reclaimable and I would advise if you possibly can OPTING OUT OF THE BARCLAYS PERSONAL RESERVE.

  • I spoke to my bank about this and got called into a side room, was told that my request was 'unlikely to succeed' and that with the credit crunch happening that they may be forced to withdraw my overdraft if I submit a claim. Are they allowed to do this? I really need to put in a claim as I'm a bit Broke and the charges they've levied against me go back many years to my student days. I meant to record this threat on my mobile but couldn't get it to record in time.

When i made my claim against Barclays last year i asked what my £11.50 'account fee' was. I was told it was for general handling of my account and included things such as car breakdown cover, mobile phone insurance and personal injury insurance.

I pointed out that i never asked for these as i have my own cover and why the hell would i be willing to pay twice for the same cover. They said i would have been informed of this when it all started. So i challenged them to provide me with strict proof that i was informed and that i signed and agreed to this.
Just a few weeks later they offered; as a gesture of good will 12 months repayment of £138.
I accepted this amount as i had also just reclaimed nearly £4000 in charges. the day the money hit my account i walked in, emptied my account and closed it.;)

May be something worth checking out still..............????????????

  • HALIFAX OFFERING LESS THAN I ASKED

Wonder if someone can help me!!!
Asked the HALIFAX for my charges to be refunded to me due to financial difficulties.
The claim was for £2700 with interest. £2100 without but went for with interest.
Heard nothing from them for 3 months so wrote to them saying they are breaking the banking code as they had gone over their time limit and was considering taking them to court.
Got an offer from them this morning of £2000.
Thats £700 short of what i asked for!!!
Anyone ever rung their bank and asked for the full amount or should i just grab the money and run?
Also they said they want to use my money to pay off my £850 overdraft?
    Can they do this??
Any comments or advice greatly appreciated x

i rang the halifax to ask for criteria on hardship. the lady took my complaint over phone said i did not have to write to request for charges back. two days later got a letter usual charges are lawful etc etc when i rang the number to disagree i was told that the weiver on harship cases was for people who had no income at all. i explained that although our joint account had money going in every month that was my husbands salary and since having to finish work in march after being on the sick since last july through a spinal cord injury i only now have DLA instead of a 1000 monthly income she said i probably would not be heard under financial hardship. i argued the fact that we are in hardship now 71 pound compared to 1000 a month is a great difference. she said it would be looked at again but dont expect to much....

sorry that is a bit long but has anyone claimed on a joint account..

    thanks xx
  • should i bother claiming back? and ifso, can i use them old templates to help, or do i have to state new things in a letter? im a student and im being charged again, 90 odd quid and i cant affored that. ive got no money in my account and once i get charged 90 quid i will get another charge which will bring it over 120 quid, then when i get paid for my part tim job on the 15th (200quid a month) i will hardly have any money left. does anyone have any advice? thanks for any help

I've only just spotted this thread. I applied to reclaim my charges from Halifax a few months ago but thought everyone was waiting on the result of the court case? Have I missed something?!

Congrats to people who have had success by the way!
  • Hi joa

all claimes are on hold until after the court case.
But if you are claiming through financial hardship you should have your claim reviewed.
  • Hi

I am currently compiling a reclaim against Lloyds TSB and have been told that I can claim overdraft interest fee only if I am claiming compound interest (I assume this is correct). What is compound interest? and how do I apply it / figure it out?

Please can somebody explain to me (in simple English lol ;) ) what the difference is and other options are?

Also if I wanted to claim hardship how do I do this? We are struggling for money at the moment and not looking foward to winter when our combined income may getreduced making it worse!

    Many thanks

    :o
