  • Hi, just wondered if anyone is in the same position as me. Am currently trying to claim back charges from the Halifax, just got the letter to say 'we regret we cant refund ' blah blah blah... Am worried now about this 27th july business... Do I still go ahead and threaten to take to court or not? The letter from the bank said 'if we dont hear from you in the next 8 wks, we will presume you are happy with the decision'....As if!!!! So do I bother with the court threat, the thought of it all is quite scary....:confused:
  • Hi, I have two issues

    1) My wife is claiming appox £1500 from RBS. For two months of phone calls RBS stated that a letter would be sent out ( approx £1400 ) but the other day RBS stated that there was no letter and declined to say anything more.
    What can be done in this case?
    2) My claim with HSBC approx £5600 - HSBC have made an offer of £3500, I am unsure whether or not to accept this or try and fight. But I am in financially difficulties and am behind with my mortgate. If I accept I hope to receive the money within 2/3 weeks.

    Any help/advice much appreciated

  • I am no expert, although my first thoughts are:

    1) I too received verbal indication from Lloyds TSB, I never received anything in writing and am still progressing this through the County Court.

    2) If you have an offer of £3500 and you are behind on your mortgage, it would make sense to accept this. The alternative is your arrears on your mortgage will continue to increase with will reflect your credit rating. If the test case is successful for the banks you could come out with even less or at worse nothing. By that time it is likely your mortgage provider will have issued an application for possession. I suggest quit whilst the going is good.

    If the egg account is for a credit card, then yes they shouldn't be affected by the latest developements because the Credit Card fees already went through a similar process last year. I have already had a final offer from Halifax of £612.50(from a claim of £1574.00, which of course I have declined) I have passed my case on to the financial ombudsman who have informed me that the original estimate of 3 to 6 months would be greatly reduced due to the financial ombudsman stopping dealing with any Bank account Claims until the test case has been heard, so if it is for a credit card then I would say yes start claiming but remember that I believe you should deal with your credit card company first before passing the case onto the financial ombudsman.

    Anyway I hope this is of some use to you!!

    Hi there - I am in the same boat I have been trying to claim from Halifax since April - I received the letter you are talking about - pushed on and sent the court letter and just received this weekend an even longer letter from Halifax again saying they believe the charges lawful. It also basically says not to try the ombadsman or county court as they have already aplied for a stay etc.!! I have no idea what to do next and if they are just trying to scare me off!!??
    Can anyone else advise??

    I too had the notification that the charges are lawful. Phoned the number on the top of the page & requested that my case was reviewed. I was asked if I was aware of the news on the 27th, I said "Yes", but I still want my case to be reviewed. I was advised that, my case would be put back into the queue & I would hear in due course.

    Bearing in mind that it seems that HBOs are dragging their well heeled feet, as I commenced my reclaim in March & only recieved my statement in JULY:mad:
    they have actually delayed my claim.

    I have calculated my charges as £5,137 & I am not requesting interest as well, I think I have let them off lightly.......
    Keep up the great work martin :A & everyone:T :T :T :beer: ......it's about time the little people had their say. we should query, question & complain more often:money:
