no idea what to do!!!

having failed the ESA tribunal and i had my DLA one last week. now appears i am not entitled to that either despite being on HRC and HRM indefinite since 2010 and prior to that HRM and LRC since 2006
in 2012 they reassessed me supposedly because the original decision was made on my say so only. this was untrue which i proved at the tribunal as it was based on a DWP drs report
i have osteoathritis, fibromyalgia, RSI in both arms. i can barely walk, cant make a meal, am in pain most of the time, cant get upstairs on my own etc etc but no i am due nothing
we cant sign on for JSA as we bought a flat some years ago as an investment. its empty and costing us money. we cant find a buyer or a renter so we are stuck
seriously i just dont know what to do anymore. we have no money coming in and apparently no entitlement to anything
i know no one can help but i had to rant somewhere

Sorry to hear of your position but do appeal your dla and esa decisions as many of them are overturned on appeal,good luck.0 -

It seems they already have appealed. shykins, you say you cannot find anybody to buy or rent your property - do you think it is overpriced? Are other properties in the area selling/ being let? Does your partner work, and do you have more than £16,000 in equity in the property?
Have you looked into the reasons why you failed at the tribunals? You could reapply, but you need to consider this question before doing so to see if it is worthwhile.0 -
yes turned down at tribunals on both. have asked for statement of reasons but not received either and they say could take months!!!
flat is the lowest priced by some margin but its only a studio and apparently they are out of favour right now in this area!! yes have equity in it hence cant apply for JSA. hubby cant work as i need too much help and even if i didnt hes 62 so who is going to employ him round here (we are very rural!)
i am hoping to reapply for both but that wont help unless i get it straight away, like i said no idea what we are going to do

Has your husband worked in recent years? If so, he could apply for CB JSA, and add you as a dependent. The fact that he probably would not find work does not matter, as long as he fulfils his agreement (which is pretty basic in the early stages).
There are some circumstances in which property can be disregarded, but I can't think that any would apply here. It would be worth contacting your local authority to see if they have anyone looking for a property - with the new under occupancy charge they may have a suitable tenant.
What evidence did you supply with your applications/ appeals? Did you have any help completing the forms?0 -

. Do you have any money available to you at all right now? If not you need to sort out something until you get your statement of reasons for appeal, http://www.trusselltrust.org/, you can check for your nearest food bank if needed. Old style money saving board has some excellent tips on cutting down creatively. Not sure if this will help, but you could double check your entitlement to anything, http://www.turn2us.org.uk/.

OP,Have you thought about letting your local council know about your Studio?

we didnt get any help with the esa forms etc as to be honest we thought we had MORE than enough information to be put into support group. the DLA i was just called for a re-assessment
ineed it says u have to be referred by social services to foodbank so not sure how we would go about that. we live very frugally but theres only so much u can cut down on
the flat is a millstone round our neck now, we bought it so we would have some income in our old age, sort of backfired now!!!

I had a quick look on google, from what I can make out you can contact your local CAB for info on referrals, they should put you in contact with the right people (I can't say for sure on that sorry as I've never used one so I'm unfamiliar with the process, I think your given a voucher according to what I've read. CAB will know more). Could you maybe do an SOA (statement of affairs) and see if there's any other areas you could save in? I think you can do one via the turn2us website I linked before.
