Foxtons Keep Deposit

Hi,
Foxtons took a 5k deposit - after a while they pulled the papers. Without answer questions we had about the property. Which we said we couldn't exchange without hearing the answer to them.
We then looked to buy another property from a different EA but same vendor. We were told by the new EA that she would get us our deposit back.
And of course we hear today that we won't - because they say that that we didn't buy the property (as they re opened/gave us the papers back on the first property - so second time we let them down????)
Foxtons have treated me like poo from the beginning (first time buyer) they have bullied me all the time.
Any ideas on what to do or am I just screwed?

p.s. the new EA said they would get it back for me. Later on (after too late) they said I should ask for it back. Hmm. The language changed completely.

what was the deposit paid to Foxtons for?
what does it mean that they 'pulled the papers' ?0 -
The 5k was a deposit to reserve the property
Pulled the papers means they took it away from me - so I couldn't buy it
The 3 questions I had were not answered until AFTER they pulled the papers
The second property I asked the same three questions and I got the answer the next day.0 -
Are Foxtons a solicitors or an estate agent?0

I guess the deposit went to the vendor.

£5k to 'reserve' a property for sale?? From the way the OP writes, English may not be their first language, so not familiar with the property buying process in Enbgland/Wales.
OP - what 'papers' are you referirng to? EA's do not hand out the contract of sale for a property, that comes from the vendor's solictor, via your own solicitor.
Under what terms and conditions was the deposit handed over to Foxtons?"You were only supposed to blow the bl**dy doors off!!"0
