    Although it hasn't been sold in 4 or 5 years - it was the last new build one from the vendor - and so is NOT off plan.

    Pulled the papers is the way they spoke about it (Foxtons)

    Either you do this, or they will pull the papers (i.e. I won't be able to buy it any more as they won't deal with me)

    Papers being what ever documents they have given to my solicitor to look at/use

    Under what (written?) terms and conditions was this deposit handed over to Foxtons?

    The contract of sale for the property does not come via the EA - it comes from the vendor's solicitor.
    You need to speak to you own solicior ASAP about this....

    This is in an email from foxtons:

    "[FONT=&quot]It is £5000 to be paid by credit card. Generally it is 21 days to exchange contracts and I would expect them to request that you use a recommended solicitor that they have dealt with before."

    I just hope I didn't sign it / give them the money and not have the contract for the deposit... will keep looking

    Who are 'them' - the vendor(s) ?
    Did you appoint a solictor to act for you?
    Did you actually pay this money to Foxtons using a credit card?
    What, exactly, did you sign???

    Them would be the vendor

    Yes I have a solictor - but he just emailed me today that they are not going to give the money back - they say the new EA "do not have any knowledge as to the terms on which the reservation deposit was paid"As they are the ones who said if I buy theirs they would make sure I get my deposit back.

    I think I went into Foxtons and the money went via card to the Vendor

    So what were the actual terms on the reservation deposit was paid Foxtons? I'm struggling to believe you only 'think' you went into Foxtons and paid them £5,000 and don't seem to know for sure.
