    $850 2bh is loads a month I used to get $150 a month..
    I thought that he couldnt force the sale of the house till the children are out of full time education? I dint think he can expect u to pay all the morg and then take half the profit for something he hasent payed...? Id seek legal advice..

    I'm in a similar situation to you and my solicitor said to me that my ex would still be entitled to half the house even though he pays nothing towards it because although I've paid the mortgage on my own since he left, he's had to pay to rent a flat, so it evens itself out :-(!

    maybe you could look at it that from the £850, just under £300 goes on his share of the mortgage then you are left with over £500 a month for the children which is more than many people get
    It is common for the person staying in the property to take over full payment of the mortgage as the other person will then have to fun alternative living arrangements

    I'm not sure how divorce and splitting of assets works but one thing you have to remember is that the child maintenance he pays goes towards putting a roof over the children's heads (so basically pays towards your accommodation as you're the resident parent).

    So he is indirectly contributing already.

    I can't believe there are pwc who actually believe they should be entitled that sort of maintenance :( as Caz says don't you think that you are already getting enough towards maintenance AND mortgage? That in addition to all the benefits you are entitled to working only 4 hours a week? Don't you think you have as much a responsibility as him to contribute toward your children?

    Whether or not he is entitled to 50/50 spilt is another matter for the courts.

    The mortage payment has nothing to do with it though as it is jointly owned and your living thier means *techinally* you owe him half a rents payment which would probally be more then the mortage payment...

    Techinally you should be paying him *something* for living thier...sorry but thats how it works.

    Consider it a 50/50 shared ownership property that you own 50% and have to pay rent for the other 50% but that rent payment counter acts the mortage payment (so if the house was rented at £700 in the market you would pay £350 but he would have to pay £300 mortage = you owe £50)

    This isnt the first time I've posted about the rent/mortage post as most people don't look at it this way (but its how the court look at things if one person moves out and one person stays)

    I don't think you were being unreasonable but just didnt see it that way, I think getting out of the house would be a good idea, and end day £850 *is* alot which is why you are getting stick for it....if it was £100 a month and you wanted help towards the mortage I am sure you would have MSE's fourms sympathy.

    If you can have benifits you should take them, even if you just put the money into an account for when the kids are older it will only help them.

    Also if you sell the house and rent you would probally recieve housing benifits which you dont recieve whilst your on a mortage.

    I agree.BUT I imagine it's the fact that his maintenance is paying the mortgage on a house he'll force sale of and then get back is what is winding the op up.

    I Also can see it from her view when she becomes a student.It's all well and good saying life changes and your responsibilities come first,but when we're constantly told by nrps and their friends and 'girlfriends' that they have a right to a 'life' (ie choosing the irresponsible options,ignoring their responsibilities and deciding they can do what they like at the detriment to others) I can imagine what a slap in the face it is when the pwc cannot do anything or will struggle.If you get what I mean!
