Looks like my Cicas application has been accepted:

    "Dear Mr Stoney73

    Case No: xxxxxxxxx - stoney73 v T-Mobile (UK) Limited

We acknowledge receipt of an application for adjudication by the customer, a copy of which is attached for the attention of the company.

Please note that any further documents submitted after this date may lead to your application being restarted in order to give the company time to consider them.

In accordance with the rules of the scheme, the company is now required to submit two copies of their response to the claim, which should be returned to us within 14 days of receipt of this letter, that is, on or before 30/05/2013. The company should list all papers being submitted, and where possible submit their response by email. A copy of any defence to your case received from the company will be sent to you and you will be given the opportunity to make any comments about it which you wish to make.

Please be advised that the company may contact you in order to negotiate a settlement of your claim. If they do that but no agreed settlement is reached they must still submit their defence to your claim by the due date above.

The company may decide to settle your claim in full, ie to give you everything you are claiming in your application. Under these circumstances the company will notify us and we will write to tell you. We will close our file at that time because the adjudicator has no power to award any more than is claimed.

We will contact you again in due course.

    Yours sincerely, "

Here's hoping. Just out of interest, how much compensation did everyone ask for in their Cicas claims?

I have just received TM's response to my CISAS complaint - I have until 23 May to submit my comments on their response to CISAS.

Can't be sure, but I think the reason it's not being put on hold is because of the Customer Service issues I raised, in addition to the breach of contract terms?

As well as requesting cancellation without penalty, I claimed £200 compensation - £100 for poor customer service over the RPI rate dispute, and £100 for TM refusing my request to go to CISAS (they told me to seek independent legal advice - no mention of CISAS or the small claims court).

Did TM make an offer to settle? Or just their standard denial denial denial?

As regard to the compensation, I believe I may have been greedy, I asked for the equivalent of the remaining months of the two contracts I have, each have 17 months left at £31, which is what T-mobile would ask of me for an early termination fee.
To be honest, I don't expect to receive anything, It's just the principle of it. If they can make outrageous demands, then so can I.

Random Curve has seen an article on the BBC website under their 'technology' section on EE - he's asking if people could call the BBC and ask them to do a follow up story on the fitness of the Board, and refer to the EE Directors Story email (post #602)?

The number to call is 02087 438000, and you need to ask for 'Breaking News UK National' - you can also say that Edwin Lane of the BBC is aware of the Directors story.

Nope, still very much in denial...

It's been mentioned previously on the thread that if you argue your case on the RPI rate alone, then you won't win. Have a look at Random Curve's rationale posts further back in the thread - I think this approach will give people the best (only?) chance of a positive outcome.

if you dont mind me asking what was the template or wording (word for word minus any sensistive info) did you use to send to CISAS?
also when did you send it in (just looking at time frames how long it norm takes etc)

I submitted my application to CISAS on 23 Apr, it was accepted 29 Apr, and T-Mobile had until 13 May to respond (they responded yesterday, but I think the 2-day delay was down to an admin error).

Have a look at post #756 for a form of words (agreed with CISAS) for your application summary.

I used the full 750 word limit, and my own case was complicated by the fact I have both pre- and post-Oct contracts, but I'll PM you my wording and you can use what you want for your own if it helps :)

Thanks for the earlier youtube link ruflonger... would love to know if the guy took it to CISAS and what the outcome was. I notice someone pointed him to MSE in the comments.

Anyway I have some good news now - after a nudge to CISAS they have reviewed my case and have now accepted it and so its over to T-Mobile. The more cases against T-Mobile they have, the more pressure grows on T-Mobile and they more CISAS must surely see that its not just one person making a fuss and this is much bigger and affecting many people - no smoke without fire as they say!
A big believer in karma, you get what you give :A

If you find my posts useful, "pay it forward" and help someone else out, that's how places like MSE can be so successful.

Hopefully the more breach of contract complaints that get accepted by CISAS, the more the pressure is on T-Mobile and they cannot continue with their stupid 'business decision' argument.
