    It seems a win win situation for Tmobile, in IanR2012 and my case they get the line rental anyway, provided most people don't complain they get the millions from the price increase with only a few thousand lost through a handful of compensation claims and CISAS charges. In my case, if I was happy to let Tmobile continue to take money from me then why would I have spent hours putting in a claim only to be told I didn't need to pay a cancellation charge and £50 for my trouble.

    I have just received TM defence to my SSC. They have used almost cut and paste from the CISAS document apart from a section they included the CISAS judgement.

    Any advice on what to do next?

    Follow the process to continue with the SCC claim? :rotfl:

    Seriously though, if they are using the same defence as their CISAS defence then I think all you need to do is look at the successful claim decisions from CISAS and use that / those arguments.

    I modified it slightly to suit my particular situation. I believe this serves a better example for your timing.

    I totally agree with RC that you should go for a full back-dated refund. Stressing that you took TM's statement has truthful and honest, which has proven to be incorrect. However, treat it as a bonus if the adjudicator gives you this.

    I haven't been following the thread for a while, but just to say, no problem at all with my old post being uploaded (I don't know why the original has disappeared, to my knowledge, I haven't deleted it).
    That is absolutely shocking! When you think EE cant sink any lower, they pull a stunt like this!

    I accepted the CISAS decision last week, I left it right upto the deadline so I could get as much free service from T-Mobile as possible. Today I received this email from Carmel Codd.

    I think all she is saying is if you don't want to wait for her to arrange the PAC, then phone Customer Services for one, but it will cause a early termination charge, and you will need to contact her to remove it. I don't think its a malicious or nasty message.

    That wasn't in relation to my case! I was talking about Ians post.

    I was simply posting up the email I had received to share with others!

    What was the reason you lost?
    • Was it because the adjudicator decided that the case was too complex for CISAS
      • in which case your defence should state that the outcome of your CISAS ruling has nothing to do with the substantive facts of the case, but purely a view that the case was unsuitable to be dealt with by the adjudicator, and should therefore have no bearing on the SCC decision
      • State that-Mobile are right that the court should consider the adjudicator rulings in the cases where the substantive facts have been ruled on (and then quote case ref numbers and adjudicator from as many cases as you can). PM the list below and ask for help if you can't find the details on the forum.
    • If your loss was due to another reason can you remind me of the ruling and I'll see if I can come up with anything for you, but I think the main points from the winners were:
      • Your interpretation of the clause in conjunction with the timing of the letter and the wording of the letter (Current RPI) could only possibly be referring to the February RPI, in cases of ambiguity under the UTCCRs the court should rule in favour of the consumer.
      • T-Mobile can not rely on a rate that has yet to be published as neither they nor you can know what the rate is.
      • Ask the court to take into account other CISAS rulings (as per sub bullet 2 above)

    Received a "final bill" from TM on Friday - crediting back the final months contract rental, BUT they have deducted (i.e charged me) for a few pence worth of "out of contract items".

    My CISAS ruling was. I thought, quite clear as follows:

    "Therefore, my decision is that the company shall terminate the customer’s agreement without penalty and refund charges incurred since 6 April 2012, and provide the customer with a PAC code, an apology and £150.00 compensation."

    I can't see any reference to netting off "out of plan" costs - so another email to TM just for the hell of it! :)

    All sorted - within 24hrs!!!

    As they have not actually billed me for the charges the can't refund them, the bill was for "information purposes only" and no money taken from the account.

    Still glad I contacted them as it seems they think they owe me another £27 - I have no idea why, but I'm not going to ask :).

    I checked in again with Ofcom - I asked them how come they can announce to the press almost immediately that TM have acted reasonably, but have taken 4 months (so far) to actually investigate what has happened?

    The response - Still investigating and will let me know when they have reached a decision.

    Seems I may have to keep up my emails with them a while longer!!

    And I need to contact my MP again to see if he received a response from Ofcom and the Secretary of State.

    Finally got my money off T-Mobile just over a week ago!

    £280, £50 compensation and £230 backdated bills, which included around £60 of apps from the android play store charged to my bill :)

    I won't be going near T-Mobile/EE again, and will be avoiding all but 1 month contracts from now on.
