    When did you get your notice? What month did the letter state for the date of sending? Mine said April, therefore the month before is march. Now March RPI has been released it is 3.3%. The terms although long winded are actually a bit woolly. You could argue that on the first of April the RPI for the month before (March) is either 3.2% because that's the latest available figure that's not been renewed, you could also argue that there is no figure for march until they release it halfway through April.

    Did T-Mobile forsee this and intentionally only put a Month on the letter?

    I certainly think the sickness is a ploy, and stating they received the email on the 16th is too much of a coincidence. In peoples reply were there still the message headers and/or the original email within the reply?

    I also got the same email - word for word from Stephanie - my she has been busy.

    I emailed back - copied in Olaf.Swanteee - stating that I was not prepared to wait 7 working days as the contract gives me the right to IMMEDIATE cancelation , which they should have carried out on Friday 14th (as that is the deadline I gave them in my original letter to them). I told then I expect a response by Noon this Friday (the date I put in my second letter for them to respond with reasons why they think they are not in Breech). I also stated that if she was unable to find someone with the correct authority level then I expect Mr Swantee WILL be able to find someone!

    I still think that those who requested cancellation BEFORE 16th April are on good ground as the contract was breached and we requested cancellation - therefore there is no contract for them to apply an increase to. I also said that I think those who did not will still have grounds for Breach, but that I can't reveal what until 9th May -I think I will revel the grounds on 6th May (pm) as that will give you time to react - but not T-Mobile!

    Has anybody had anything in writing from T-Mobile stating that they used Januarys RPI? if not would ADAMONEIL88 be able to obtain a transcript of his call to T-Mobile?

    My email - for info.
    As they have not responded yet (Read receipt received), I will email again (to OLAF and Jackie (I think they my have created a "dummy" email account for Stephanie as I have had no read receipt from her! - and it has a "2" on the end)). I will state that they are being deliberately obstructive and will use this as part of my evidence against them should they not cancel the contract.

    Thank you for your response to my email which I received on Tuesday 16th April.
    Unfortunately the actions described are not acceptable to me. T-Mobile have ignored my letter of 6th April in which I gave T-mobile an additional five working days to respond over and above the contractual IMMEDIATE response which I was entitled to demand, therefore I am not inclined to agree any further delay in resolving this matter.
    Given that Jackie O’Leary is currently otherwise engaged what would be acceptable to me is if a named contact would email me (either today, Tuesday, or Wednesday) confirming that:
    • They will respond in full to my email by Noon on Friday 19th April as per my letter;
    • They have the authority to instruct the T-Mobile payments team not to take any further sums from my account, nor pursue me for payment until our GENUINE DISPUTE is resolved;
    • They have the authority to cancel the contract without penalty to myself – should they agree that the contract is breached;
    • They will clearly articulate the reasons why T-Mobile believes it is not in Breach -should they conclude it is not.
    I have copied Olaf Swantee into this email as if you are unable to find someone within the organisation with the correct level of authority to deal with this matter as above – he will.
    For the sake of clarity a response after Noon on Friday 19th April is unacceptable, as is an email response from a generic mailbox, or from somebody who does not have the right authorisation levels.

  • I am actually on the phone to them now. I have stated over and over again the terms and conditions. She has offered me the 2013 price plan....a saving of 17p a month and the use of 08 numbers!!!! I have asked for my PAC and she told me that i will be charged £298 for this. I pointed out that this charge should not be incurred for the obvious and even if it was this charge would only apply when I give the PAC to another network. Been on the phone now for about 40 minutes.

    Can you ask then to send you transcripts of all of your calls - especially the one where they said they had used January - or get them to say it again and ask for this calls transcript???

    Calls are only kept for 30 days so you'd be more than lucky to get that. And that is even if the call was recorded. Only a very small percentage actually get recorded.

    I just got put through to retentions to a Scottish guy called Robert (team number 501). He read out a different version of the T&C 7.2.3.3. Basically its the same until it gets to 'for the 12 months...' and states that his say something like 'a time that is reasonable'. I said that the T&C I had in front of me was quoted to me word by word by previous colleagues and he basically said he didnt know where they were getting their information from but it was wrong!!

    Strangely I have been trying to pull up the t&c's on the tmobile website and I just get 404 - Page Not Found. How coincidental.

    You would be better going straight in with a SAR because I can practically guarantee they won't look for your call!
