    I think you should use it now, if you really want to avoid a court hearing.

    I think you should not sit and hope and wait for the inevitable court hearing.

    I think you should be proactive and rattle PE's cage to show you are fully aware of their recent lost cases v Sharma and Gardam, as well as Fox-Jones. Also that you know about the irregular dates, details & signatories in their debunked 'witness statements' and are ready to see them in court unless they choose to cancel now. That's an option if you want to rattle their cage but not make an offer.

    And if you want to, try the option of offering to pay £25 to them if they drop the court case and agree to go through POPLA in order to spare the court's time and as POPLA is the most suitable Alternative Dispute Resolution. That's an option if you want to make an offer, and if you do, word the offer in a separate letter, separate piece of paper headed up 'without prejudice save as to costs'.

    We have seen lots of cases dropped, but you have to cause them to drop it.

    Your defence sounds as if you could have added more as well, hence why a strong letter now is recommended. If it does go to a hearing you will need a stronger defence than that...and you cannot just turn up with it on the day...
