    WI has a point, you know, although his words can be somewhat harsh!

    There's nothing to stop anyone, even those who don't want to have a bank account, from opening a basic bank account or indeed a building society/bank savings account, neither of which allow overdrawing, and then withdrawing their pay in cash when they receive it.

    If that makes budgeting easier, then why not revert to doing everything in cash?

    I know that the answer is that it's more convenient to use a bank account, and cheaper. But isn't that the point - people value the convenience and cost savings they derive by using a bank account, but don't want to incur charges for doing so?

    If anything, the judge was more sympathetic to individuals' inability to keep control of their bank account balance than I would be. The argument that you can't be expected to know when a cheque will clear is rubbish - when you write a cheque, you should have the funds available and then make a NOTE of the outstanding cheque until it clears. Similarly with debit card payments.

    And his comments re direct debit payments were also incorrect - nobody should debit your account without you knowing the due date, and the amount, in advance. That's a requirement of an institution setting up a variable DD mandate.

    ok the Ombudsman is onto my OH's TSB account as we have written them two letters and nothing in return but now i have seen this i am slightly panicky should i be should we just keep going? have just posted my second letter to HSBC in hope that they might take note this time oooh err

    just watched the link. Didnt really conclude anything, though have to say that the comment about calling the bank for help is laughable. Whenever I asked for an overdraft I was turned down for not managing my account (even though it was the charges putting me overdrawn in the first place!!!) and when I was offered a loan I was turned down and my credit rating got worse and worse. Cheques would be bounced as they take money out before they put any credits on your account each day... So even if overdrawn for about an hour that would result in a charge of 30/35 quid.... Nice work if you can get it I'd say!... If the banks don't want people to go overdrawn then that's the first thing they could change!!!

    This case won, as far as I'm aware only affects Lloyds TSB customers as their T&C's are worded differently.
    Does anyone know if there are any cases won today?
    There certainly doesn't look like anyone else has lost again.

    Thank you very much you have made me feel better. This afternoon whilst i took 5 minutes out of my day to see how people were getting on i was confronted by this person unbelievable comments. Like i said myself and my husband are dealing well with our debts at the moment and are really pleased with ourselves. I'm a mum to 4 children, work voluntarily for a local riding to so my girls can learn to horse ride and am purely trying to do what thousands of others are. But personnal comments have no place on here we are all trying to help each other and if these people are not claiming anything maybe they should find a new hobbie. Thanks again i shouldn't let people who i don't even know ruin my day but he did!!!!:confused:

  • i have sent off our first letter about 3 weeks ago and still not heard anything am about to send second, am a bit worried as we are trying to reclaime from lloyds tsb. should i worry ar carry on? just a quick add on, surely the new bank rules apply to new custermers and started our claim weeks ago.
