    so the blood son is seeing a solicitor about contesting the will and the POA! apparently he has phoned his dad at the nursing home, so we will find out tomorrow what was said etc, poor man I hope this has not upset him. Sad when you think dad wanted to see his son so much but the son refused, and now he's dying and the will is at stake he has found the time to call him! My poor husbands head is all over the place! Does anyone know how we pay for the solicitor to fight this, does it come from our money or from dads estate?

    I think the rule is that if you instruct a solicitor you undertake to pay their bill.

    went to see f.i.l yesterday and blood son had phoned him, said he had seen copy of Will???? and that nowhere was he mentioned, if he does not get put into will he will create problems and make things difficult. FIL said to me he does not want to leave him anything but he now feels that he need to make provisions to stop him mithering him. Hubby will report this to solicitor tomorrow, and we shall have to just see what else happens when son contacts him again or goes to see him. When he phined the nursing home he said to the person who answered that she had best be in room when he tells his dad the sad news he has, this news was that his daughter who had not seen her gramps for years and neither of her kids have ever seen him, that she had just miscarried. Yes that is very sad but why tell a dying man this???

    You need the other type of PoA, for health and welfare, I would not assume he is safe because he is too sick to be moved, people have done worse. He can only change his will again if deemed competent, I'd love to see how someone who cannot leave their bed organises a solicitor without any interference.

    Freda, there is no "estate" until FIL is dead! You do not need to fight anything. Let the other parties try to take any action as they see fit. They cannot win.

    And now the fun begins, FIL is still alive but its kicking off. Blood son wrote to dad who cannot even open an envelope now. The letter states how disgusted he is in being left out of will when he has always been there for him and a shoulder to cry on, he hasnt seen him in bloody years!! He has been fed crap by my husbands brothers none of which is true. to cut a long story short blood son is now contesting POA and will contest will when poor FIL has died!! Vultures the lot of them!

    3 letters in total, threatening to challenge both POA and Will! Poor Dad in law is on his last few days and is not even 'with it'

    Did you ever sort out the money in the second account?

    Did they ever repay the money into the first account?

    and have any of them actually visited???

    Hi RAS, they paid the money back into the first account, the second account is being investigated as we speak, and not one of them visited. The blood son has now sent another letter as of yet we have not seen the contents. The blood son has now reported to social services saying the POA and Will has been done underhandedly, they called to mother in laws house but she told them everything was ok and above board the ss man rang my hubby whilst at her house and hubby explained everything, the ss man said he was happy with everything and there was no case to answer to. His words were he has done this instead of paying money to see a lawyer!! He is ringing him monday to tell him this!
