    Hubby gave them the benefit of the doubt and is waiting to see if money has gone back into account today, he will check the balance tonight. If not he will report it to the police first thing in the morning. Will keep you posted.

    Why delay? The son who withdrew the money admitted that he had no intention of repaying it.

    Some of that money was withdrawn a month ago, so presumably has been spent by now.

    I wanted him to report it at once, he was a tad reluctant cos its family, but he WILL be reporting it when he gets home I shall make sure of that!

    As he is in a position of quite serious responsibility, he really doesn't have much choice. Not if he doesn't want to be accused of being complicit. It's not unknown for another unidentified person to be in possession of an ATM card, but quite another not to do anything about it once you know.

    Fifteen withdrawals of £250 in a month is nearly FOUR GRAND. Difficult to pass that off as a "mistake" or just paying for something necessary on some else's behalf.

    What a filthy toe-rag!

    Oh also need to ask the banks to start investigating the withdrawals; they may well have CCTV coverage of the brother taking the money but may only keep it a short time.

    I would also be inclined to get in first amd make sure the Public Guardian's office are informed about the situation.

    Yep, get onto the police and report this as theft. Which it surely is. Your OH is never going to see a penny of it going back into step-dad's account. "Entitled to it as next-of-kin" is a load of baloney. Greed and utter dishonesty, pure and simple.
    Just a quick insight into this relationship. Mother married stepdad she had 6 grown up kids who had fled the nest, no money, no house, he had money and a paid up house. She never worked in the 35 years they have been married. He did. She never loved him. since him having to go into a nursing home last August she has not visited him at all. Step dad has always been close to my husband and decided over a year ago to change his Will leaving everything to him (he was leaving it to his blood son, but as he and blood son have not spoke for 15 years, he is not leaving him anything). (letter in Will explaining to his son why). Husband also gets the house once mum dies, as the Will states she can stay as a tennant until she dies. He does not want her to have a penny from his monies. My husband told her though, when step dad dies he will arrange to pay for her utilities out of the money. After this though I doubt he will give her a penny! Now we are waiting for mum and her son who took the money to contest the Will, even though she is a Trustee of the will.

    It takes a great deal of money to contest a will, so it's unlikely that she would be able to do it. Presumably if she's a Trustee she knows the contents of said will. Isn't it going to make life rather difficult if she's a trustee after having abused her husband's assets already and he hasn't even died yet?


    I wonder if it's possible to contest someone's position as trustee when they have proven themselves to have little integrity?

    Thats what makes us so sick, she was so for the Will being in favour of my husband to his face, but behind his face its a different story! She is a nasty hard woman and my husband fell out with her for many years because of the way she was with his late dad. Hopefully she will not contest but if she did with the backing of her favourite son would it cos us money to 'fight' it or would it be between her and the courts? I havnt a clue how you go on about contesting a will?

    Well, I hope she doesn't either!

    Honestly, it costs tens of thousands of pounds, so if they are the sort of family who steals a terminally ill man's money, they are probably not the sort of people who would have the resources. One short visit to a solictor should put paid to that idea.

    I'd be looking into how she could be got rid of as a Trustee. Stealing his money might be pretty good evidence as to her complete lack of integrity.
