    just heard from solicitor that blood son is threatening to contest the POA and will, saying dad was doped up on morphine and didnt know what he was doing! He was not on morphine at the time and the sol has written to gp to get this confirmed, our solicitor is getting paperwork ready for when it goes to court. sol says he doesnt stand a chance as he will sytand up in court and say 100% dad was of sound mind and no-one else was in room when dad changed the will. Like the solicitor has just said there will be only one winner and that will be the solicitor as he will have to be paid. So mother in law has shot herself in foot as any money we were going to give her to live on will now be used in legal fees, and her and blued eyed son will not be looked on favourably when it comes about about the theft. We have yet to find out what they have taken from his other account, which hubby has only just got control of! Watch this space.............

    Sadly if we win we cant claim our costs back from otherside, the only way maybe to say it has been done out of spite! Which is true as its my hubbys brother who started it all. His philosophy is if he cant have it then no one can, he doesnt realise the only looser will be his mother!!

    Thank goodness this poor man has you you and your husband to protect him from these vultures.

    My father remarried after my mum died, after his second wife died he found she had fleeced him, lots of money had been withdrawn from their joint savings account, which of course she was entitled to, but she didn't tell him and did it when he was recovering from a minor stroke. He was devastate to find she had cheated him.

    I suggest that OH gets his point in first and writes to the Public Guardians NOW pointing out that

    1. Mother and Step brother have been helping themselves to the old mans accounts to the tune of £XK and that OH is attempting to get this money returned.

    2. They seems to think that OH has taken the old man's money, not that he is tending it on the guy's behalf.

    3. That as a result of OH's attempts to retrieve the stolen money, Step brother has contacted the son who is now kicking off.

    4. Point out that NONE of them has seen fit to visit the old man and describe the way in which each behaved towards him prior his going into the nursing home.

    5. Confirm that such spends are made are all receipted and documented.

    By the way, can you find other things like foot care or massage that he might like?

    In which case warn the home that he might turn up and let them know he might cause trouble if he does.

    hes already phoned the home asking for my husbands phone number which thery refused to give, husband will phone the home when he gets in to check if son has gone to see him. He has foot care from a choropodist and hairdresser who come to the home and i always do his finger nails. Can we write to the public guardians or had we best let the solicitor do it?

    It's a delicate situation. If you have POA for health and welfare then you can control who visits the old chap if you believe a visitor may have a negative impact on his health and welfare.

    In that case you need to contact the Social Services/ health providers who placed him in the home urgently and tell them what has been happening. The son could quite easily move him or take him to another lawyer if he wants.

    There appears to be a history of elder abuse already and the rest of the family dont seem to care if they harm the okld man if it is advantagous to them.
