power of attorney

Options
My husband has lasting power of attorney for his step dad and has just had his name added to all the bank accounts etc as this guy can no longer manage his affairs. My husband has just received a bank statement and £250 in cash has been withdrawn 15 times in one month. Stepdads wife (husbands mother) still has her husbands card for this account. As she is now mainly housebound it seems her other son, who step dad disliked and he sidliked him has been given the card by his mother and made the withdrawals. this could now get messy :( as my husband is going to go and confront his mother later and ask who has been taking out the cash. Bearing in mind this account is in step dads sole name and his private pension is paid into it each month, step dad is now in a nursing home. could this be a matter for the police? My husband is worried because he has to account for every penny which goes out of step dads account and he is only using it to pay any bills step dad may be running up himself which is very little.

Get your husband to contact the bank today to cancel the card and issue a new one and new PIN. Shouldn't be too much trouble if he's got LP of A.

problem with that is she still lives at the address and will get the new card/pin ??

possibly get the bank to cancel the card and NOT replace, use online banking to pay bills etc ??

I would report it to the police , even if they cannot prove who took the money then the offending person will get a shot across their bows if interviewed

The bank probably has a telephone service still operating at this time of the day. Ring them now and ask them how many cards there are and what mechanism was used to withdraw the money.

Rbs/natwest fraud dept is open 24 hours so give them a ring tonight. I imagine other banks are the same.

the card we have found is from his savings account not the current account so she must be using his card and pin number. we have now stopped this card at the bank.

Well you've 'lit the blue touch-paper' by cancelling the card, stand back and wait to see who starts screaming first....

he is going to confront his mother tomorrow, he is going to say 'we have a problem, money is being taken from account and he is concerned so is informing the police', he will wait her reaction and if she says '?? took it or I took it' then he will say you have 7 days to put it back or else I am informing the police/fraud dept as this money is my responsibility and I have to account for every transaction.' Watch the fireworks begin!! There is also another account with the post office which she refused to give him the card for, again this is in stepdads name only! He will now demand this card back too. He has not been able to stop this card as we no details for it, so has had to fill a form in at PO to inform them of POA! Money sure is the root of all evil!

well she confessed it was her and said she had her other son take it out and she thought she was entitled to it as she is next of kin, bearing in mind no one else in the family liked him and mother has not seen husband since last september when he went into the nursing home. she did say she would get it paid back in but now 3 hrs later and the other son has turned up (the one who took it out) says they are not putting it back!! This was all said on phone, so husband told them he has no choice but to report it!! the phone then went dead!!

Yep, get onto the police and report this as theft. Which it surely is. Your OH is never going to see a penny of it going back into step-dad's account. "Entitled to it as next-of-kin" is a load of baloney. Greed and utter dishonesty, pure and simple.
