This still makes no sense to me. THe only possibility if this post is true,is that because of your own refusal to take the time to check the suite at time of delivery you have invalidated your delivery contract..dont know if this is legally acceptable though-you should have mentioned this at post number one-not post 20!!
well if they didnt deliver at 3 o'clock and considering i'm a single parent and had no other way of getting my kids picked up from school then i would have made time at 3 o'clock to check it thoroughly.thanks for your observant point.i'd love to be perfect.....i told the drivers it was an inconvienient time and they said ok we understand and theres a bit on the receipt that says i didnt have to inspect it fully .......cant remember exactly what it is ,because all the documents have been returned to visa......and at the end of the day,they have agreed it is faulty with me ,as they sent someone out to verify i wasnt lying .0 -

You have had a suite delivered, which Land of Leather's man has admitted is faulty. So really "isn't fit for purpose" and that is what you should be fighting for to get your refund. Ignore the signs in LOL and look up you rights ( i think there is a forum on here just for consumer matters), ring up trading standards and have a look at this link. It looks like you have done everything right to get your refund which you are entitled to.

Also supply this link to your credit card and ask for their comments, and what they propose to do if LOL wont pay you back.
Before everyone starts to disagree with what I say read all the posts then look at the link. This is a law and what LOL are saying on their signs is wrong.
Please let us know how you get on, as I am sick to death of large companies trying it on when there are laws to protect the consumer.0 -

today after a few weeks of letters to and fro,i phoned my bank.id bought a sofa from land of leather and didnt check it til home at night,anywy went straight to shop to say it had a rip in it.so was told to check it thoroughly,which i did and that they would send someone out ,anyway.after the faults i came across when the guy came he agreed i was in my rights to return it .both sofas were differnt colours.one was ripped(tiny rip)base wa sall scurffed down bottom and side,one sid eof a chair had a marrl through it .like knotted wood would have.anyway spoke ot bank today and the ysaid i had to provide a proof of fault document,ie:- get a independant person to view it and if they say it was unacceptable then they would get me a refund,then she said during chat,that land of leather dont do refunds so tough.i asked wat i could do,and she said you def wont get a refund now and we wont persue it , but we can haggle over the price due to the fault that the company says it has and are willing to exhange it by the way...please advise.is mastercard wrong ,cos if the ynot ,then why am i paying card protection?......................

As far as I am aware LOL can NOT have a no refund policy on faulty goods. You are within your rights to request a full refund. Your credit card company should be pulling the money back from LOL and crediting it to your account.
After so much time haggling this it may be your only option now to go through the small claims courts.0 -
Stupid question, but what's wrong with a replacement? By buying the sofa, you obviously liked it and wanted it, so if they're offering to replace the faulty one, what's wrong with that???
I mean, if they'd supplied you with 3 faulty sofas in a row, and you were fed up with them, THEN I'd understand you wanting a refund, but you haven't even given them a chance to give you an undamaged one, which after all is what you wanted.Should've = Should HAVE (not 'of')

well,i have been informed by the bank that because land of leather and i have different avents of the faulty sofa,then they are not willing to persue the matter further.and they said they will prepare there legal staff for court as i said i would fight their decision in ourt,as far as i am aware regardless of anyones opinion ( anywhere, also here ) of what i did rightly or wrongly, i am entitled to a refund f goods are faulty which land of leather stated in a letter to me they were.and yes i think i am within my rights after all the titlle tatlle from land of leather staff and banking staff to request a refund,maybe if .L.O.L or T.S.B hadnt been so ignorant and arrogant on contact then i might have taken a replacement but i dotn see why i shouldnt have been dissallowed from a refund ...anyway i'm not updating this after this post,but only wantd to say how it had been going,my thanks to all.0
