credit card dispute

today after a few weeks of letters to and fro,i phoned my bank.id bought a sofa from land of leather and didnt check it til home at night,anywy went straight to shop to say it had a rip in it.so was told to check it thoroughly,which i did and that they would send someone out ,anyway.after the faults i came across when the guy came he agreed i was in my rights to return it .both sofas were differnt colours.one was ripped(tiny rip)base wa sall scurffed down bottom and side,one sid eof a chair had a marrl through it .like knotted wood would have.anyway spoke ot bank today and the ysaid i had to provide a proof of fault document,ie:- get a independant person to view it and if they say it was unacceptable then they would get me a refund,then she said during chat,that land of leather dont do refunds so tough.i asked wat i could do,and she said you def wont get a refund now and we wont persue it , but we can haggle over the price due to the fault that the company says it has and are willing to exhange it by the way...please advise.is mastercard wrong ,cos if the ynot ,then why am i paying card protection?

    Why are your Bank (or is it Mastercard?) making statements about whether or not Land of Leather will refund your money? If you paid by credit card for these sofas, there credit card company is equally as liable as Land of Leather if the goods are faulty.

    why did they refuse to pursue it when they found out it was land of leather?

    have you spoken to land of leather about this? you said the guy agreed on a return, wasnt this their guy?

    if the goods are faulty then you have consumer rights regardless of what the credit card company said

    I am shrugging my shoulders at why you need someone independent to tell them what is obvious to anyone - that the goods are faulty!

    when i complained to l.o.l.the first night i got it delivered they said they'd send someone out,.2 weeks later they did and the person( independent person) said i had grounds for a replacement or money back.but it the nastercard who are being a pain in the butt...they insist i get an independant person to agree with l.o.l.and also said that because of l.o.l.....t&c's then i am not entitled to a refund.i personally think they read my original letter wrong and think that i got the independant person as she firs tsaid to me when i called,we want the proof.i said ,but i told you in the letter,they got proof not me .well you will need to ask them for a copy of it and send it off to us.and we want it in the next 5 days.or we will presume your not taking it further.i am at my witts end here.and l.o.l.wont reply to letters that are gettig sent recorded delivery....

    Best advice I can give, is ring mastercard and ask to speak to a manager and start again because you are getting nowhere. Make sure at the beginning of the conversation you get the managers name, and just deal with that one person.
    When there is a problem csa's and managers seem to be more helpful when you have their name.

    Why are you even talking to Mastercard? I don't understand why they are involved.

    Your dispute is with Land of Leather who have supplied you with a faulty sofa. They have admitted this, so it is now their responsiblity to get either replacements or a refund.

    i want a refund and them to uplift,and they want to replace.so i have made a claim on my visa for the refund and under the faulty goods/credit act,i'm sure i am allowed to,or even in the terms of my card protection cover,but l.o.l.say no....so it at a stale mate.......

    i have stated this to the visa and l.o.l.and also trading standards as i asked their advice when it came to a stale mate with l.o.l.

    i'm not into complaining but i will stand up for what i think i am entitled too,i paid £2000 for faulty goods and i dont want them replaced.i dont want them repaired,i want a refund.l.o.l says they dont do refunds.wat else am i suppose to do....go ad hit them on the head and tell them they the only ones not getting it .i got i from the start what my rights were(or atleast i did)

    where you aware of the no refund policy?
    generally its quiet obvious if companies dont offer refunds as signs are plastered all over and in my experience there are very few companies who operate a no refund policy unless its for things such as say underwear and earrings for obvious reasons

    mastercard should process a refund for you regardless of what land of leather say. its their job to then claim the money back of land of leather, not yours
