Just a an aside I want to say thanks to the people on here who give people advice - when you read the posts and you see people asking the same/similar questions, it is admirable that every time you find the time to give worried people an answer. You are all stars!
That's the one to appeal against, you had 28 days.
I do advise appealing and using POPLA, as do most pepipoo forum posters now.
As well as suggesting you read again the link I gave you before, to the pepipoo thread by bikerjp, I would suggest you look at the 'signage' part of the BPA Code of Practice (on the BPA website). Then quote it at UKPC and point out where they have failed to comply with the Code. There are requirements regarding clarity of signs which must be readable, must be at the entrance and regularly around the car park.
And include reference to the VCS -v- Ibbotson claim, as already advised - they have to mitigate their 'losses' which would reasonable NOT mean watching a driver walk away and 'cause a made-up loss' to them!
Also ask them in a separate paragraph, to clarify whether their 'charge' is issued under tort of trespass, or contract, or breach of contract, and to clarify whether any loss has been made and by whom. If the loss was allegedly suffered by the landowner/retail occupier, then how does UKPC pass this on to them and how is this loss broken down? {There are reasons for asking this!}.
Finish by saying you will require a POPLA code of they reject your challenge.
We really can help you to win at POPLA if you take specific care when wording the POPLA stage of the appeal (just an email but needs a lot of strong detailed points). And POPLA costs the PPCs money, so it's the best plan all round IMHO.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
