Help no proof

Hi i was delayed for 18 hrs from palma returning to glasgow back in oct 2006. I dont have any proof the flight hit the head lines as michelle moan was on the same flight and tried to charter a flight herself for us all due to the appauling treatment we received. Is there a chance i can claim?

Kind regards
H. Kelly

Sorry Kelly but you are out of time.

As the FAQs say in big red letters, it's six years for court action. So if the airline says no to your compensation request, you have no legal redress. And because they know you have no legal redress, the airline will say no. Sorry!:(

you are free to write to the airline and make a claim but if they say 'no' (which they likely will) you cannot take the next step which is court as you are outside the 6 year limit for that
  • The Glasgow flight was due to leave Palma at 12.15am on Sunday. But it was cancelled when the plane was hit by technical problems.

Passengers arrived back in Glasgow at 8.30pm on Sunday.

EasyJet said they provided accommodation and pounds 20 food vouchers after it became clear that the flight would have to be cancelled. That was a few hours before we were due to board. The story has a lot more as accomadation wasnt provided there was a young disabled couple whos bags were on the plane and personal things needed from them as the lady wore incontinant pants. My sister who is a nurse reasured them not to worry we would get it sorted. The couple were lovely but no one from the airline gave a second thought for them. We stayed with them the duration of the time we had to wait on the flight, which ment my two kids endured the experience. Also we didnt have money to pay for accomadation and travel to and from. I dont think this is a case of delayed compensation only but the manner in which we were treated basicly left to deal with it and that couple would of been left on there own i think i deserve some answers as its not a grab a pound for delay case but more ( a think) please advise me what you think thanks

You have already been told that you are out of time. It realy doesn't matter how bad it was, and it may have been very bad, the legal time limit in the UK is 6 years, so do not waste your time taking this any further
  • I think the newbie sign should be read !!For anyone else who can see further than 'what I have already been told' whats the exeptional circumstances its clear to see must be some as the redress only goes 6 yrs although 2005 is the time that can be claimed back to. Also the law is just passed therefore the two yrs before the legal court time period that covers the 6 yrs which leaves 2 yrs uncovered by the court. I read exeptional circumstances but it doesnt go into detail that I saw, I only wanted to know if the length of delay would be considered for the '2yrs' before the time covered by courts.
Wasting time asking questions that are just for a quick quid agreed but not asking about the 2yrs the law says you can claim back to, although not covered by the court!!!!

I'm sorry Very Tierd. I've read your post three times now, and I still don't understand what point you are making. There has been no "two years uncovered by the court". And even if there were, I don't see how it would make a difference to your claim.

Anyway, by all means write to the airline and ask for compensation. But they will say no, and then there is no further action you can take. I hope that is clear, if unwelcome. Sorry.:(
  • The 2 yrs is 2005 - 2007 which is over the 6yrs where the court will assist only going back 6 yrs But the law say the claims can be from 2005 i just wonder why the law just never looked at there dates and what they assist people with in there court room, crazy thats all the so called inteligent people who enforce the law scary haha.
I wouldnt go to courts for cash back although it does make you wonder if the flight had been a year or two later that I could claim with the backing of the courts.
Sorry if i hadnt explained properly hope you can see my point now and thank you for your reply. I can imagin loads trying to claim just to line their pockets when really 3 or 4 hours is unfortunate but not that bad, when stranded in the airport for 15+ hours with no money as you are thinking no need to keep any and then told if you want a place to stay then fork out the money and transport to get there, not to mention money for a meal. And why do they bloody not give vouchers out when passengers are hungry instead of waiting less than cpl hours before the actual flight sorry about that rant over . It does make me angry the way some of them treat the stranded passengers but thats life.

Amen to that last point. Let's hope this law makes the airlines up their game!
