I believe the time from applying to the Small claims Court to the case being heard is quite lengthy. Has anyone had a case heard or has one pending with an agreed date specifically about the 50% reduction in settlement for a delay of between 3 and 4 hours. Once one case is heard, despite the advise given, it will give an indication of the full reason why Monarch are taking this step in defence and the courts decision. I feel the 50% reduction is an entirely different issue to claims being denied for extraordinary circumstances.
I can tell you the full reason now.
If a claimant doesn't take Monarch to court over it, then Monarch do not have to pay, and there is no comeback or fine or ANYTHING on them whatsoever.0 -

I'm giving up. I think the claimants should only get 20% ...0 -
Is somebody aware whether the CAA have contacted Monarch about the 50% reduction in flight delay compensation for delays of between 3 and 4 hours. If so how did they respond or have the CAA just sat on their backsides and not bothered posing the question. This is especially relevant as what Monarch are saying about the Sturgeon case goes directly against what it says on the CAA website. One does get the impression the CAA are "!!!!!footing" around the airlines on this subject.0

I am fully aware that the best course of action is to go the Small Claims Court. What nobody seems to want or is able to answer is whether anyone has started court proceedings against Monarch for the 50% reduction in compensation, and if so as a result have Monarch paid up in full or are they prepared for the matter to go to court. Also has anybody already had their Court hearing heard on this issue and what was the judgement.0

Not so far as I know. But as it takes about 5 months for a case to come to Court, I wouldn't expect to see any for a while.0 -

Don't say that, folk will start complaining and thinking of ways to jump the court queues!0 -
