I appealed to POPLA about a parking ticket given in December for stopping on Liverpool Airport access road I had just left airport just after 1st round (100 mts) and car spluttered and car refused to pull I was stopped for 30 seconds before it started to run correctly this is the time given by VEHICLE CONTROL SERVICES but the appeal was thrown out because I stopped the fault on the car and engine failure does not count at all the VEHICLE CONTROL SERVICES RULES it say is you CAN NOT STOP UNDER ANY CIRCUMSTANCES THEY SAY I WAS CAUSING AN OBSTUCTION YET NO OTHER CARS ARE IN THE CCTV PICTURE PROVIDED THEY ARE IDIOTS They now want £100-00 well they can try I will go to court first and let a magistrate judge case

It won't go to court as a breakdown can't be accounted for, there is no loss to vcs and its simply a penalty. It also won't go to magistrates court as the claim is a civil one in a county court ie the small claims.
The Popla decision is not binding upon you, so unless vcs are stupid enough to issue a small claim ignore it and the parking company completely.When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

What are you talking about?
This won't even go to a County small claim court let alone Magistrates, it's not a crime. It's a scam by VCS and you seem to be taking them far too seriously!
Why don't you just read all the other Liverpool Airport threads on here? There are a few, and no-one is paying, they are ignoring the whole scam or they are using their POPLA appeal codes (I assume they sent you one with the rejection?).
If you have got a POPLA code please draft what you are thinking of saying in your appeal after you have read other Liverpool Airport thread (you only have to put those two words into the 'search this forum' box and click 'show posts'). Seems like they DID whack in any old appeal to POPLA then, without help and without any challenging demands for the PPC to provide evidence for. Pointless and very sad as it could probably have been won if properly worded.

I would think that I broke down would be enough, I mean how can that entail a breach of alleged contract ? Can you imagine this disaster going to a small claim ? What would they say, yes the defendant broke down, but that is against our terms so we gave him an invoice as punishment for having the audacity to do that!

It seems a bit bizarre to me that the BPA COP has a section on grace periods for car parks but POPLA have not allowed any grace period as such in this circumstance.
Now I know OP didn't want to stop and it's a different situation, but nonetheless had this been drawn to POPLA's attention and an appeal made incorporating this point, who knows what the outcome may have been.

In this case it doesnt matter that Popla have ruled against, the charge is even more ridiculous than usual.
If the Op has any record of a breakdown agency attending ( ie RAC etc etc) then thers absolutly no chance of this going anywhere.
If I was the OP, i would fire a complaint off to the airport, stating what had happened and that I would consider the letters from the PPC to be harrasment - as the PPC are agents of the airport, the airport would be liable.
Plus this si the sort of thing that the local media/press would relish - motorist breaks down on airport road, and the airport is harrasing them/threatening them demanding a penalty of £100From the Plain Language Commission:

from WEDDING1944 the latest from VCS we have received claim forms from Northampton County Court who have issued a claim for £152-94 from VCS we have filled out form on line to court "acknowledgement of service" telling reasons for not paying the fee that VCS has put before court in that the car broke down for 30 seconds and that is the time given by VCS watch this space0
