Am I entitled to a refund? As i'm being refused!

Hello,

I would greatly appreciate if anyone could give me someone advice with my situation.

I booked an event online for tomorrow (23/03/2013), however, i'm unable to attend due to being very ill. I payed £60 for two people to attend. I have called up to ask for a refund or would it be possible if i could change to another date in the future.

They told me that they can't issue me with a refund neither can i change to another date. The only option they gave me was to try and sell the tickets on by tomorrow and get my money back that way.

Furthermore, i have looked on their website and it doesn't state on the terms and conditions that i'm not entitled to a refund nor have they stated that the tickets are not transferable to another date.

Here's their terms and conditions for their website...

Legal.

By agreeing to these terms and conditions you further indemnify the organisers / promoters from and against all legal liability in respect of any costs, claims, damages, demands, penalties, actions, proceedings, suits, losses or expenses in respect of or arising out of the injury to or the death of any person, or damage to any property arising from your participation in the chosen ghost hunt activity.

Rarely, ghost hunt events / courses are cancelled or postponed by Night Vision Investigations due to weather conditions or situations out of our control. When this occurs, Night Vision Investigations will make every effort to ensure you receive a prompt refund of payment. If the event is moved or re-scheduled, Night Vision Investigations may set refund limitations. Any expenses including travel incurred due to the cancellation of a ghost hunt event will not be refunded. Should you wish to cancel your place(s) on your chosen hunt you must inform Night Vision Investigations without delay and the matter will be discussed with you regarding the possibility of a refund full or part.

Your acceptance.

All event bookings made through Night Vision Investigations means your acceptance of our Terms and Conditions in full.

That's the only part in their terms and conditions that talks about any kind of refund or cancelation.

Am i entitled to a refund?

    This is why you usually have travel insurance before going on holiday - in the case of illness (for example) you'd typically get very little back from the holiday company, and the balance would come from insurance.

    Whilst the event here is different, the principle is the same.

    You have entered into a contract with them. You are cancelling at very short notice not giving them the time to get an alternative ghost hunter in.

    It's not the companies fault you can't go because you're ill. Either sell the tickets or take the hit.

    Surely they must put on their terms and conditions that people are not entitled to a refund under any circumstance. Their terms and conditions state above i'm entailed to cancel my event with the possibility of getting a refund. They don't state that you have to cancel within a certain time frame either.

    Wouldn't this make their terms and conditions invalid as costumers are made to believe they are entailed to a refund if they wish to cancel the event for whatever reason? If you go on ticket master or another site where you buy tickets, they make this very clear.

    Give the tickets to the other person that's going and let them take a friend. At the end of the day you've spent the money anyway and your loss would be you personally not being able to participate. The plus side is you could feel all warm and fuzzy because you've treated two people.

    Where does it say you are "entitled" to a refund?
  • Hmm well it looks like i either need to shift this flu before tomorrow or do as you said try and sell the tickets or let the other person take another friend. Thanks for you help, I just needed to get a better understanding of the situation.
