Well I got a letter today containing what appears to be my original application form for the credit card and original credit agreement, the terms and conditions at date of default, another credit agreement for this date! The application form has my signature on it. The other agreements have no signatures but it does say on the original application form from 1998 that it forms part of the credit agreement.

Similar to what they sent me. Does the agreement have boxes for your signature that are blank?
Application forms do not prove the debt is yours, only that you applied. If the Credit Agreement doesn't have your signature on it how can they prove these were the terms you agreed to and signed? They can't.
It looks to me that they have used a recon to satisfy your CCA request.0 -

On the original application form the section I have signed is in the part which states that it is a credit agreement regulated by the Consumer Credit Act 1974 sign only if you want to be legally bound by its terms.
The credit agreement has my name and old address printed on it stating it is an agreement between them and me, but no signatures or spaces for signatures. The terms and conditions they have sent have no signatures or spaces for signatures. The other CURRENT credit agreement they have sent has spaces for me to sign regarding PPI insurance but no other spaces to sign.

Hi
The original application form is very small only has all my details etc then the credit agreement section with the signature box. It then has a paragraph on financial particulars which is unreadable which states it forms part of the Terms and Conditions overleaf.

Well it looks like - from feedback from various people that its enforceable so where do I go from here???
Is there a letter I can send to agree nominal payments for 6 months then I could try and negotiate with them again on a full and final? The only thing is they have the upper hand now :mad:0 -
From what you sent me, I'd say most of it is illegible! It's badly copied and you can't read most of the credit agreement.0
