Capquest are strange. I CCA'd them last year and they send me the same info 5 times without asking for further security.
Personally, I think they've got nothing. I'd be inclined to write back stating that if they are suddenly concerned about security and confirming your ID they shouldn't have written to you in the first place.
Maybe they're hoping they can lift your signature off a piece of ID to make it look like they have assigned agreement. Who knows? Either way, send them diddly.0 -

Thanks Gordon - I agree with you I don't think they have the original CCA (it was taken out back in 1998!). I do not want to send them any id with my signature on because as you say they may try and use it. I think I may just send the letter Ferni suggested and wait and see.0 -

If they don't send anything then they haven't complied with your request. The account is then in dispute, they can't sell it on or enforce in court intil the dispute is resolved.
They're not too clever, Capquest. Trust me, had a run in with them last year. After seeing them off with template letters I haven't heard anything for over a year.0 -

Its not that I don't want to pay it I just want them to negotiate!! They have also added a default to my credit file saying it is a bank account and not a credit card!!! I know I can add an notice of correction to my files - which I may have to do if this is not resolved! Will let you know what happens next!

That's fine, but you need to find out what they hold first. If they aren't willing to send, or can't send, because they don't have the CCA then it puts you in a much stronger position to negotiate.

Hi I sent the letter you suggested Ferni and today I got a reply saying that "with reference to my request for further information they can confirm that they have requested it from Capital One but they are still waiting on a response! My account is now on hold. They state they will contact me again within 28 days to advise of the situation and add that if Capital One respond within the time period of 28 days they will contact me immediately!!!!"
I do not believe it the last letter I got said they had received the info from Cap One and I had to give them identitiy proof before they would send it to me!!! Now they are saying they havent got anything from Capital One!!! What a bunch of idiots!! Obviously they didnt like the last letter you suggested Ferni!!
So should I wait another 28 days?? -

Yes I cant believe them!! I think I will just sit tight - my ideal result is to do a full and final but get the default removed from my file too so I guess the longer they take to come up with any info the better....although I did want this resolved sooner rather than later - I kind of don't think a speedy solution is possible so I will just bide my time.
Will keep you posted on any developments but thanks for all your help!:T0
