Don't worry what TC do or don't do. You have told the Court of the outcome and they should remove the stay and list the case for hearing.0

You would loose your court fees though. Details here on what they might be:

You would also loose all the time and effort you have put in (some people value this, others say they have plenty of time and not doing anything else anyway) along with any other costs you have incurred such as stationary, postage, travel costs to court, etc.The above is just my opinon - which counts for nowt! You must make up your own mind.0 -

I understand you can also be asked to pay the other sides reasonable expenses - such as travel and overnight accommodation (if required).
But only if you were deemed to have acted unreasonably would you be asked to pay for their legal costs.
In practice I have never seen anyone who has lost a case against the airline ordered by the judge to pay any of these. But it is a small risk I suppose.0 -
Thank you. The court fees aren't too much so if we lost then that wouldn't be too bad.
Thanks for finding the info for me.0 -
we have received an email from the CAA dated May 2014 basically saying that in the light of new guidelines clarifying extraordinary circumstances of EC 261/2004 the disruption falls under exceptional circumstances, therefore they say we are not entitled to compensation.
Would the new ruling make any difference to this decision as we have a deadline to get this sorted before Sept 2014. Unfortunately the CAA did not disclose what the exceptional circumstances were.
What is our next plan of action?0
