  • Hello again gang... I bear very exciting news!! After doing the MCOL application and receiving a letter saying Iberia were going to defend the case, I thought I was in it for an even longer and harder slog. But today I had a letter from a lawyer saying they are going to settle in full! After chasing them since 2009 I am so overwhelmed I don't know what to do with myself... or what would be the most fitting and celebratory way to spend the money... :) Thanks to you all for your advice and support. I couldn't have got here without you.

    You could look at the "US and Canadian Airlines" thread and there used to be a "successes" thread.

    At the end of the day, the answer isn't of anything other than academic interest however. If you have a "fact pattern" that fits the criteria in the law, you are more than likely to win.

    I've come from that thread but can't see anyone who has won a claim from Delta.

    I wanted to know if I had a good chance of winning before I took them to court or otherwise I would just be wasting my money.

    With respect, that's a strange question. What have other people's cases got to do with yours? If everyone who took Delta to court won, that wouldn't matter a jot if your case was weak, would it?

    Forget the airline. Look at the facts of your own case, against the law (as explained extensively on this forum) and decide if you think you are owed compensation or not. And if you can't work it out, think about going with a NWNF company.

    I don't know, I'm probably just asking pointless questions. Its getting late lol

    Maybe I should just contact a NWNF company. The mad thing is that I'm more angry about the way they treated us than the delay / missing connecting flight / arriving a day late to our destination.

    I reckon about half of us would have let it go had the airlines treated us properly with up to date information during the delay period.
    In my case I was in Palma airport for 7 and a half hours with a 4 or 5 euro voucher for food when the airport workers were on strike and everything was shut :undecided
    We also sat there looking at a screen saying that we were to start boarding 2 hours ago right up until the plane arrived. No info, no help, no monarch staff in sight.

    Its shocking how they treat some people and get away with it. We were travelling as a family of 8 with Delta (including one disabled, one pregnant and two children). after arriving at JFK we were stuck in a section of the airport with no toilets, I had to beg them to let us go back to the toilets before my daughter wet herself. There was no food services in that area, no vending machines or water fountains. After about 6 hours they brought us a couple of packet of peanuts and some coke! We weren't even allowed to use the phone to call my family waiting for us or the hire car company. Oh and eventually they said they booked us in a hotel for the night, after waiting another 2 hours we finally managed to get a taxi to the hotel only to be told they hadn't booked us in and there were no rooms left! The hotel were great though as they gave us some food for the children and let us share one of their staff rooms for the night. Luckily the next day we were flying from Newark and the airport staff there were so much better and were shocked at how JFK treated us.

    My parents flew with United airlines a few years ago and had a similar delay problem but they were given food vouchers and kept them informed throughout and when they did get home they were sent some flight vouchers each.
