Hi Can some one help please.
10 days ago I sold a laptop on a facebook selling page, the photo was a stock photo but the lady came to the house spent 5 minutes playing with it checking it out, she wanted it and paid.
Today 10 days later she has tried selling the laptop on, but had no success she messaged me and said she wanted her money back as it didnt hold charge and charger didnt work.
I asked why she hadnt informed me sooner but I got no answer just threats of her husband and brother coming round to get the cash. She also wants to call the Police stating that the laptop in the pic wasnt what she bought, no it was a stock photo but she spent time looking and testing it before buying. My husband is all for giving in but she wants the money NOW even though 10 days on I havent got it.
Can anyone advise me whats best to do.
Thank you

How did you describe the laptop - did you state that it did not hold charge?0
-
No and thats what is confusing me it does or did hold charge well, when she was testing it it wasnt on charge and was fully charged. Also when she is trying to sell it she states in perfect working order. I have a laptop that is identical and have offered to swap batteries but no she wants the cash.0

To the best of your knowledge, was there a problem with the charge? Surely for a private sale, it's caveat emptor? i.e. buyer beware. As long as you have not deliberately mis-represented the condition of the item either in the advert or in person, then I doubt she has a leg to stand on and you can ignore her empty threats.
The only thing which does occur to me is whether Facebook has any mediation type service (like ebay, where a buyer can complain at will) which might mean she gets her way?
Also, do you have a record (screenshot) of her attempted sale? Bet she didn't mention anything about the charge/r etc.
Edit: just seen your post.
I would refuse to give her the cash, nor swap batteries.
Just write back, saying caveat emptor and decline to enter any further correspondence with her.0 -

Her insistence on a refund makes me dubious, do you think she has simply decided she doesn't want it and is trying it on? Also do you have a serial number or can you identify that the one she has is definitely yours? The only thing which does occur to me is whether Facebook has any mediation type service (like ebay, where a buyer can complain at will) which might mean she gets her way?
Nothing like that I'm afraid - the selling groups are very informal.
I would be inclined to offer to meet her to see the (apparent) problem for yourself. If you do this obviously make sure you are not putting yourself in danger - have someone with you and make it clear you are inviting her, and not her family too.0 -
Hi Yorkie she has removed the advert. Can you explain Caveat emptor please0
-
Thomas the laptop she is trying to sell is definatly the same one. If we ignore her she bringing the family round, as she knows where we live, I have tried explaining it a civil matter and Police wont get involved.0

The Police may get involved if you tell them of her threats - are the threats made on FB or over the phone? Some days you're the dog..... most days you're the tree!

You're right, it is a civil matter, and I imagine as soon as she tells the police "I bought it off Facebook ..." they'll politely tell her where to go.
Caveat emptor means buyer beware, they should have checked it properly before agreeing to buy.
If she didn't know where you lived, I would agree with Yorkie1, but I would go concerned what they might do if you took this route, hence why I would try to keep it amicable.0 -
The advert was a stock photo but described accurately, but she inspected the actual laptop before buying she is now saying its not the same laptop as in photo. I cant prove it was holding charge this was 10 days ago now, she has stated she wants money before Mondy as they going in caravan, another reason shes just wanting money I think, its the threats that are worrying us.0
