paypal sides with seller and the tracking number doesnt track

just had a email from paypal to say that 'the seller has provided proof of postage indicating that the item was posted to you, because the seller was able to provide proof of postage we cannot reverse this transaction or issue a refund, we encourage you to work with your seller'
They need to show that the item was delivered and not just posted!0 -
thanks all, will call them on tuesday as we are out tomorrow. makes me sigh really as i had a item a year ago which was sent recorded and delivered on the royal mail website and paypal decided with the buyer and refunded them, about 2 weeks later i checked the royal website and it had been updated with a signature! i couldnt sit on hold waiting for paypal to sort themselves out, that was for £14.00 but this is alittle different, its £180!!!Listen to what people say, but watch what people what people do!!0

thanks for all the replies, phoned paypal and went through the case, kind lady agree that the investigation was closed far too early and she had indeed tried to track the item using the number and she couldnt either, so she said they allow 21 days for the tracking information to update so shes open the case again under appeal. which is something.....Listen to what people say, but watch what people what people do!!0

I had just wanted to contribute some information - if not too late for the discussion?.
I am a buyer on eBay since the past few years, though had been a buyer before this.
I can truthfully say without any exaggeration, at least 5/6 out of every 60 parcels (est) do go astray in the post when I buy goods from eBay. I often buy in successions however, and the postmen have quite a lot to deliver to me, I presume that they either drop somewhere en route and/or sellers might incorrectly send to a house address and not the verified flat number they possibly think is a house number is not at all clear.
It is also the case that I used to work for RM and more than aware of what takes place there and how they have a mammoth task of Christmas advent parcels that don't get completely sorted through until March/April. Even recorded parcels are among some of these is also very true.
I have to agree with the fact that the RM tracking website is far from functional and traces parcels competently. I once returned goods worth £100 back to an eBay seller as they were faulty - the track and trace website simply failed to even recognize any such parcel was in existence. I lost both my parcel and case for refund from seller because of this and why I rarely if ever, return goods back to any seller on eBay due to the sheer risks involved in doing so, recorded or not.
Not just the above eBay parcel went astray, I have rarely had any need to send anything in the post apart from letters - through the recorded services, only for these also to go missing in the process!. Either I have been very unfortunate, or the track and trace means of sending things just not up to its job? - too many coincidences in my experience does not fill me with trust regarding RM traceable postage.
Italy is some post depots away from the UK, yet even if recipient does get your parcel, is still no proof of receipt of it - esp if the postman on duty at the time does not have an electronic signature recording devices for example - even someone who lives at the same address who signs for it, can also make proof of receipt void.
However, I keep my fingers crossed for you and genuinely hope you have some news very soon?!

I've got letters tracking from all over Europe within 3 days of postage at the moment, but not Italy, so I don't know how they're operating.

hi all, further problems, after paypal opened the case back up i had a email yesterday from paypal deciding in the buyers favour, again stating that he had provided a valid tracking number. i phoned them today and asked them to track it and they said that they have and even though it does not provide delivery for Italy there rules are from postage from italy just need to provide proof of postage and a tracking number!!! i said that is crazy as we havent had it now i'm out of pocket, i cannot believe that is the rule for italy... its £180.00 and worse is that i cannot claim any further as i used my bank card to fund it not a credit card.
So i'm basically stuffed, the girl said she agrees with me but if she opens up an appeal the same rules will apply and someone will close it down again.

i only have one tracking number so it would need someone that has access to the other tracking numebrs to see if they are the same or how old it is.Listen to what people say, but watch what people what people do!!0 -
Call them again and ask where this supposed rule is shown.
There terms for buyer protection specifically state delivery must be shown
13.4 How much coverage do I get with PayPal Buyer Protection?- If PayPal determines a Claim in your favour, PayPal will reimburse you the full purchase price of the item and original postage costs only.
- PayPal will not reimburse you for the postage costs you incur to return a SNAD item to the Payment Recipient or another party PayPal specifies. If the Payment Recipient presents evidence that they delivered the goods to your address, PayPal may find in favour of the seller even if you did not receive the goods. See section 13.11 for other protection you may be entitled to. You may wish to contact Consumer Direct (www.consumerdirect.gov.uk) for advice on your consumer rights.
If still no success I suggest you report Paypal to FOS
