Is it worth me appealing to CAA?

. "The departure of this flight was delayed by 25 minutes due to Air Traffic Control retsrictions. The flight arrived in Dubai at 01.17 hours Dubai local time on 9th March, 62 minutes later than the scheduled time of arrival of 00.15 hours local time.
As the circumstances of the delay were outside our control and the delay to your arrival in Dubai is less than three hours, EU compensation does not apply.
For further clarification to avoid any doubt, your departing flight from Dubai to Kolkata is not governed by EU legislation."
I was lied to by the airline in this respect as i purchased the ticket to Kolkata with a connection in Dubai both flights by them. As i was lied to about this do you think the "Air Traffic Control retsrictions" as the reason is true or not?
Basically due to the delay i arrived at my destination 12 hours later and missing part of a funeral, the purpose of my trip.
Can anyone advise as to weather it is worth me appealing to the CAA as the "Air Traffic Control retsrictions" is a valid reason as far as i am aware for no compensation.

If the delay was only an hour, how did you miss your connection, which should have been a great deal longer, usually 2 -3 hours in Dubai? Are you suggesting the delay was a lot more?0
