Advice regarding Vodafone problem

never just stop paying a contract. If you have problems its better to continue to pay while its getting sorted then claim money back.
Otherwise it could wreck your credit file and end up with a massive bill0 -

He signed up for a contract with vodafone a few months ago, when the phones were recieved he did as he was told and set them up correctly, but neither of the phones were connected properly. one of them was partially connected but with no internet at all, the other was not activated for internet, calls or texts. 2 months down the line he has now recieved a letter from vodafone stating that he owes them £131.77 and a potential termination fee of £962.31. The termination fee comes into effect if he does not pay the £131. He obviously doesnt want to pay this as the service has not been set up correctly so therefore he believes have breached their contract anyway by not supplying the correct service as stipulated in the agreement. He also believes that vodafone will at some point pass the debt onto an outside agency if this is so, then vodafone can only send a bill to the debt agency for the services used not the bill for 18 month contract as you only pay for what you use?
Can someone please shed some light on this for me so that i can pass it on to him. He is currently off work sick and can barely afford his normal bills the poor guy is stressed as it is and this letter from vodafone really hasnt helped matters.
Hi privateeye13,
Thanks for making me aware of this.
If your friend would like me to look into things further could you ask him to email me with his details via the link in our profile here?
All he'll need to do is copy and paste the link into his web browser and it'll take him to the Contact us form on our website. To ensure that it reaches me he'll also need quote the code WRT135 - MSE in the subject line.
Once sent he'll receive automated reply with a reference number. Could you update the thread with this and I'll get back to him as soon as possible?
Kind regards,
Lee

Well, the 'thing you know' is wrong.
If they close the account, ALL the forward charges fall due and payable. What made you think otherwise? Not only will they do this, and wreck the credit file, but the debt will be sold on to a third party and they will move on, washing their hands of the affair.
The time to get it sorted is before it becomes too late to do so and the damage is irreversible.
I know this as it happened to my aunt last year with vodafone, she took out a contract, a few months later she fell behind on the payments, they cut the contract, and told her she would potentially have to pay the debt and the remaining contract. However when it went to the debt agency they had only passed on the failed missed payments not the whole of the contract. So please dont say i dont know what im talking about - when im actually talking about an experience!
I know that the phone provider cant charge you for something you havnt used. If they close and cancel the contract agreement, then they are removing their rights to charge you for the remainder of the agreement ;-) When a contract is breached / ended or cancelled you are no longer bound by those terms and conditions.Doing the investigation work - you don't have time to do.0 -

They can. I think you fail to understand that it's a pay monthly contract with a minimum term, not PAYG.
If it is you who breached the contract then you are liable. Have you read the contract that you are speaking about so confidently?
Yes i have read the contract, ive also had it checked by a solicitor. Theoretically as i said if the contract is terminated by the company then you are not obligated to abide by its terms and conditions, its a technical clause that could / would be used in court./Doing the investigation work - you don't have time to do.0 -
