Faulty Xbox 360

Hello all!

I'm not sure if this thread belongs on this section of the site, so apologies in advance. My Xbox 360 has broken, for those of you familiar with one, the "ring of light" at the front has turned red instead of green. I believe this is a common problem with them. SOmething to do with them overheating!!

My query is that I intend to take it back to the shop where I bought it from (Game). Am I correct in thinking they will have to exchange it for me, instead of fobbing me off and making me send it back to Microsoft for repair. For information the product comes with a one year warranty and I bought it ten months ago.

Any advice appreciated!!

Cheers!!

    nope!!!!
game will tell you to send it to M$ as they have a 28 day warranty, after that you have to get in touch with M$ they should be a phone number somewhere, in the warranty guide that you got with the 360,
sorry but game will just laugh at you, try asking them to send it back to microsoft for you, since you bought it from there shop, wouldnt like to say what the postage would be as they are quite heavy.

Hmmm...that's what I'm worried about! Somebody did mention to me that my contract is with the shop; not the manufacturer, so I was going to try and pursue that avenue!!!

Will give it a go tomorrow!!

Hmmm....that might well be Game's answer but it isn't complying with Consumer Law AFAIK.

I am not an expert though, maybe the OP can find some info by searching Martin's articles about the Sale of Goods Act?

I had a PS2 develop a fault after 5 months, it would not read disks. Took it back to nearest Dixons (thinking that was the shop I got it from, only had Credit Card statement as we had lost the receipt!). They were rude and obnoxious but when stating my case it dawned on me that we had actually bought it at a different branch.

So I went to that branch half-expecting the same treatment....instead I got an immediate apology, a new PS2 and a new receipt 'but make sure you keep this one, it's easier than us checking our till records' smiled the sales assistant. I was out of the door within 10 minutes, vowing never to look in the first Dixons branch, ever again.

So my advice would be read Martin's info, maybe print it out & go along to Game with your xbox. Hopefully you'll find a good SA who knows the law.......post on here again if not!

    That's completely wrong.

Game may say they have a 28 day warranty, but that's only what they state. You're protected by consumer law, it doesn't matter what Game state.

Your contract is with the seller not the manufacturer. You could effectively even get away with taking it back after the years warranty.

I'd go back to Game. Tell them it has broken within 10 months and you find this unacceptable given a console should last for 5 years or more. They'll tell you to take it up with Microsoft. At which point tell them you're aware of your consumer rights and your contract is with the seller, not the manufacturer. If they don't budge, ask to speak to someone more senior.

They'll probably say at some point that they'll need to send it to Microsoft for repair. Again keep pushing, why should you wait for them to send it back, that's their issue with Microsoft, not yours.

The hardest part in all of this is proving the Xbox broke not through miss-use. As they won't take back anything. But if you can possibly show them, and explain the problem (it's a common one, maybe take some print outs from the internet from various places).

Just keep pushing, be forceful, but not to the point where they won't help you. Let them know you're aware of your rights by UK Law. You should be able to walk away with a new Xbox if all goes well. It won't be easy though.

I had a similar thing recently but with an iPod. Went to the iPod store, and the assistant just wouldn't listen to me. He kept telling me Apple's policy of 28 days, and despite me telling him that doesn't matter as I'm covered by UK Law and I'm stood in a shop in the UK, he wouldn't budge. I asked to speak to someone more senior. Very helpful. Got my a new iPod instantly, with receipt, and didn't even take the broken one off me.

I could have easily have left and sent it off for repair or even bought a new one, which is a trap many people fall into.

Yep I will just confirm what coupon mad and wolfie say, your contract is with the shop that supplied it to you not the manufacturer as UK law states.

Return it to the shop, if you have the box and all that came with it even better, pack it up and return it along with proof of purchase. what ever you do try to start with a lower member of staff the guys in polo shirts, that gives you the chance to ask for more senor staff, if you go tot he top first then you dont have that option.

get the sales of goods act and memorise it, it is brilliant what it can do for you when you ream off laws that protect consumers the shops just keeal over and give in.

Good luck and stick to your guns, it is a common problem and if the 360 is still within 1 year of purchase then return it to the shop. if not then go down the route of microsoft they will send you a reconditioned console.

Thanks to everybody for their help and advice!!

I went to the shop this morning, and spoke to a regular sales assistant! I explained the problem, showed him my receipt. He briefly tested the console and swapped it over immediately!!!

I am very impressed with that! This is the first time in 7 years of shopping with them I have had to take anything back to Game so they are most certainly in my good books!!

I was all prepared to quote the Sale of Goods act, but thankfully it didn't come to that!!

We bought ours from Argos, and when it became faulty they told us to return it to Microsoft, which we weren't happy about. To be fair Microsoft were very good, sent out a courier to pick it up and returned a new one with a few days.

Glad that you got yours sorted.

  • Hi Guys/Gals.

This morning i went to play pro evo on my 360 .. turn it on at got the red circle of death!!! this is the second 360 that this has happened to! Pheew i purchased a 3year cover plan from dixons, i can just go down there and get and exchange right? WRONG !! they told me to contact Microsoft to get it replaced!! Eh?? am i missing sumthing? At the time of purchase and the first exchange i was told i was covered for anything? so instead of exchanging it they phoned Microsoft and let me speak to them .... 1hr later in store im still on the phone to Microsoft explaining that this cant be right? knowingly selling possibly faulty goods, me buying a £55 3 year cover plan for protection and still not getting an exchange?? then the manager of Dixons started baffelling me with !!!!!!!!! my head was spinning! Microsoft said they will send me some labels (great pro evo should run great on those) in order to send my xbox360 back, for upto 4 weeks.

Have i been mugged off? have they broken any EU trading Law?

Help im soooo angry and frustrated.

    Mr Vee
