This is their defence and doesn't need to be replied to as this is up to the judge at the court case. Your defence will be contained in your court bundle, what has the court asked you to provide?0

Thanks for responding EdinburghLass, the court hasn't asked me to bring anything. I got a standard 2 page sheet, telling me where the hearing will take place and when saying I should attend 15 minutes before the preliminary hearing. Then it goes on tho say that the case may be released to a different court and Judge and on the second sheet is a standard information sheet just saying that the hearing has been listed in a back to back list, where the work is shared between 2 or 3 judges. Actually in the middle of typing up this reply, I phoned the courts just now and the lady told me it won't get sorted out because of the fact that its a preliminary hearing and they're waiting to see what Barclaycard say and I asked her if I was supposed to take anything, and she said I can do if I want to, like statements. She sounded very indifferent. Any help will do as to what anyone can advise in the same situations. I have spent countless hours on these forums and going through (sometimes) successful claims such as £1700 off Lloyds TSB current account, not so successful Barclaycard (in the middle of waiting after I applied to serve them with a warrant on the 2nd Aug 2007) and one other bank account and 2 other credit cards using Martins templates. But I find that the basic answers to some very straightforward questions I find are not on here. So I hope the answers to my questions may give someone like me some help. Thank You.;)

Submitted court form on 27/6/07
Notice of Dispute Lodged 8/8/07
Transfer to Civil Case 10/8/07
Looks like i am going to court!!Just awaiting court date now from my local Court office!
I have had no correspondance at all since i lodged the case with the courts from Nationwide. :mad:
Has anyone else been in a similar situation? Or has anyone had to attend court hearing etc?
I'm soooo worried :huh:

I tried to reclaim my banlkcharges and after a few weeks of waiting I got an offer from my bank HSBC, as it was way to short by about £450 I said no and sent the next letter. Having no joy with that I took the bull by the horns and took court action " it`s gone the 28 days the bank is disputing the whole amount I`m claiming and the mail says I`ll get a letter to tell me where the claim will be heard.
I`m worried now I feel like I`m out of my depth and wish I`d excepted the first amount. I think I`m going to loose the whole lot which is over £3000.

Hi Marie,
We all feel the same at the mo, it feels liked we've been kicked while were down. Just try to think of it as money you thought you'd lost anyway, and if the FOS don't fold to the whim of the banks, we should all get our cash back (Do I sound convincing?). Trying to be positive, and keeping everything crossed. If I'd started about 3 weeks earlier I probably would have been posting a success story on the site.
We've got to be positive on this one, don't forget that you have to go the full stretch and start a MCOL (if you haven't already). Also, if the bank applies a stay to your claim use the template letter asking for the stay to be lifted, which is on the penaltycharges.co.uk web site.

Although i posted with MCOL before the OFT/FSA/BBA case was announced i have now got confirmation that they are going to defend which i have read that means it will come back to a local court.
Is there now a possibility that they will apply for the dreaded stay?, and if so is it better for me to prepare the letter now to send instantly to the courts to trump them? also is it worth preparing a court pack now in advance of any date or location?0 -
Hi progolf, I have the same problem. I had my proceedings delayed weeks before the recent OFT/FSA news by Barclays, and now they've almost immediately entered a defence. I'm a bit suspicious...! I'm in court at the end of October. What shall I do now? Prepare for court or prepare for a stay?0

It's likely that you will get the case stayed, although some courts are not staying claims at the moment. This is the case with my local court, although I was given judgement on 25th July before the OFT announcement and yet the bank haven't paid up and are claiming that they will not pay because of the test case - even though I got judgement before the test case was announced! It's all a bit bonkers at the minute. Keep going though.0

Woke up this morning and HSBC have submitted a defence, dunno what happens now? will i be noted of a court date? will i have to pay anymore money? as im suffering as it is0
