    Hi all,
    I've received today from my local court a 'Notice that Acknowledement of service has been filed'. Is this the defence part where I have to get ready my paperwork to take to court OR just await the 28 days and file for judgement?

    Natwest paid my amount in full after I filed the claim via MCOL. I contacted the court and told them I had the money so they stopped the proceedings. This was a couple of weeks ago. Yesterday I received a letter from Cobbetts saying that Natwest are defending my claim and I got several pages of why they shouldn't give me my money and asking me for further information. Why is Natwest wasting legal fees when they knew they were going to pay up out of court? I am so tempted to either phone or write to Cobbetts telling them that their time has been wasted and the bank has already paid me. Should I do that or just sit on it and see if it goes away? The defense was dated just a few days ago, they have also sent a copy to the court.

    Including Interest £1282.42
    Reply expected by 3rd May 2007 - Ignored!
    Threatened court action - ignored! Charged again!(even though overdraft is paid off!)
    Filed MCOL claim 03/06/2007 - Acknowledged

    WON!!!!! £1,110.000 out of court settlement!
  • Ok, so I've followed all the steps to recliam something like £195 from Lloyds TSB (a very small amount, but a lot of money to me lol)
    I'm now at the stage where they have defended the claim, and I've received a letter from the courts with the details of their defence. The court is based in Northampton, which I gather is where all the claims start from.
    So I have 2 questions:

    1. How long before they transfer it to my local court with a date?

    2. If Lloyds TSB don't settle beforehand, will I actually have to turn up to court and answer questions etc?

  • Usually takes 1 week to 10 days for the notice of transfer to reach you. You then get a court date from your local court. The date will depend on how busy your local court is.
    I have had 4 claims against Lloyds TSB and although they have held out as long as poss, they have settled before court in all my cases, so the likelihood of having to attend court is slim, but you should prepare yourself for the fact that it could go all the way
  • Hello all! :)

    I took the plunge a week ago or so and filed a claim with MCO for bank charges totaling £935 inc interest again the Nationwide BS. This morning I received a response from Northampton count court and it would appear that the NWBS have appointed a solicitor and intend to defend the claim in full. I was wondering if anyone else has got to this point and also, what to expect?:confused:

    i issued a moneyclaim online to my bank(halifax) to recover my bank charges. they have filed for a acknowledgement of service which gives them an extra 28 days to file a defence. what should i do? i am getting scared is this just another bullying tactic or should i stand firm and fight them all the way?
  • hi, just recieved acknowledgment from the bank and they are defending all the claim,it is with the Yorkshire Bank and i would like to know if anyone has gone to court with them.The amount im claiming for is £2,500.inc.interest.As no-one seems to have challenge them.thank you cos im gettin prettie worried now.And is it normal for them to print there solicitor name on the defence notice or is that to worry me even more:confused::confused:

  • Dont worry this is their standard way of doing things. After they have entered their defence you will get a court date through, thats when they are likely to start negotiating a settlement. They like to drag it out in the hope that you will get scared by the whole court thing and drop your claim. Keep at it, you will get your money eventually.
