    Hi
    We too are in the process of taking Barclays to court, can you tell me how long they left it before putting in a defence? as i have read in previous posts that they automatically put in a defence to give them extra time and as far as i'm aware its part of their process!!
    So try not to worry too much.

  • this is proberbly an easy one to answer. ive just recieved a letter from my banks solicitors (acknowledgment of service) saying they are going to defend the claim. my question is what do i do now???? please help as im crapping myself:eek:

    Don't panic. You'll get a letter from the Court shortly giving a date for you to attend, but that doesn't necessarily mean you will end up having to set foot inside a Court. Quite often, they will send you a cheque settling the case, and i believe they sometimes hold out til just days before the Court date. Even if you do have to got to Court (I've got a date for first direct on the 3rd august), don't panic, you'll probably be seen with 9 or 10 other people in a similar situation. As of yet i don't believe there have been more than a handful (if that) of people who have lost their cases.
    Be brave, you'll be fine.

    HSBC put a defence in just in time and today i got a copy of the defence papers they say the following;

    1. the claiments account is goverened by the defendents personal and/or business banking terms and conditions
    2. Pursuant to the defendants terms and conditons the defendant is entitled to make a charge for its services as set out in the defendants price list, including and overdraft review fee for considering weather to provide and providing an overdraft.
    3. The defendant denies that the charges applied to the claiments account amount to penaltys at common law and/or unfair contract terms for the purpose of the unfair terms in consumer contracts regulations.

    it does go on nd on, is this the usuall speil???

    It's the standard template from their solicitors.

    Don't worry - each case can be argued against. For example, point 1 regarding T&Cs is irrelevant as your account is governed by the law over and above a bank's T&Cs.

    I am helping a friend and she has had the same response as you, so it must be a standard solicitor's letter.

    I am going to court with my friend on the 7th of August. Will let you know how it goes.

  • please help the bank have decided to defend my claim, i am not sure what to do next. the bank have acknowledgement of service giving them more time, but today i have received what they are defending and one statement says we have 'amongst other things' not shown how we came to the amount. eventhough we sent off the six years spreadsheet. but silly me didnt photocopy it please help i dunno what to do next.:confused:
