Yes I did think he would not qulaify for JSA conts only, I've just did an online calculator for housing benefit we could get £1.19 per week if he was on JSA or £36.94 if he wasn't so I will make a claim to that anyway they can only say no we're not entitled.0

Why was he sacked? Has the employer followed all necessary statutory proceedures? Has he been paid all his due holiday pay? He is due 5.6 weeks holiday per annual leave period. As he was employed before 1 April 2012 he only had to work 12 months to gain full protected rights, not the 2 years as is currently the case.
The fact he did not have a written contract means diddly squat. He is protected by the statutory rights every employee has as set down by the employment legislation.
If he feels he has been unfaily dismissed he may find it beneficial to speak to acas or the CAB[SIZE=-1]To equate judgement and wisdom with occupation is at best . . . insulting.

Ok thank you I will look into that. I am assuming the days he is going to get paid is the holidays he has accrued so far this year.
I don't want to specify the reason for his sacking on here but he didn't steal, assault anyone or anything like that.0 -
I would definiately try ACAS in the first instance they answer the phones with a helpline, the CA you have to make an appointment but still well worth doing.
Do hope you manage to get things worked out.
Maybe try negotiating with the Electricity & Gas and reduce the amount paid each month rather than just cancelling it?The most wasted day is one in which we have not laughed.0 -
I was just thinking of cancelling it as it's due in a few days and I'm not sure that's enough time to do all that? But I will contact them first thing and see what my options are.

A lot to think about for you but ring utility companies. Also read your meters I know it's a silly thing when you have all this to think about but you maybe in credit if you are paying monthly DD?The most wasted day is one in which we have not laughed.0 -

No we were actually going to increase our DD for gas/elec as our bill ( we recently gave our estimates) was higher than estimate due to having a young child and it being very cold over the winter so this couldn't have happened at a worse time0 -
Thanks for advice. I will make sure he goes to jobcentre tomorrow, it's a 5 minute walk I know youneed an appointment but he can still go up and they can advise him.
It was a small company with only a few employees, he started 1st March last year so has literally only been there a year. He had no written contract. I told him I don't know how many times to sort that out but we were just happy he got a job (was out of work for a year and it was the frist he had been offered). So he wouldn't really have a leg to stand on. He is going to get a weeks pay, I didn't know this earlier I was trying to get my head around it all.
I have cried my tears and now trying to pull myself together, I have cancelled my gym membership (was a month to month baisi so that's not a problem) and I will give sky notice of my cancellation, been with them less than a year so can't cancel until April. I will cancel the direct debits due (gas and electricity) and contact them to advise of situation.
I still need to pay a months nursery fees as I need to give notice, my son loves nursery my heart is breaking at the thought of having to remove him0 -

Well it was very cold for a while as you say so understandable. Terrible times for people. Do hope you get some help if they have sacked him due to no work being available then hopefully you should be ok and get a bit to help you out.
Whether he actually had a writen contract or not makes no difference, if anything it puts the company in the wrong for not providing it. xxThe most wasted day is one in which we have not laughed.0 -
It's really horrid when this happens.
Ring the Tax Credit people, see if they can adjust your claim (being end of the financial year, not sure if that is the case).
How old is your son? Just wondering if there is any nusery funding I may be able to suggest. It won't be full time but keep him used to it.
I know when my OH was made redundant it upset me too, thinking they needed to stop nursery.
He has a contract, implied terms etc so if they haven't followed procedures and it is not gross dismissal then get some advice (there is a board on here).
Can't give anymore advice, but I know how worried you are right now and it's rotten.0
