Very grateful for all the input and advice you guys have given me and I hope you won't mind me sharing a letter that I'm prepared to send to NG Collections, unless you think it will prejudice me and I hope you don't think bad of me for the ending but this type of stuff is quite stressful and if it's possible to upset the perpetrator a little bit then I'm all for it.

I am in receipt of your “Formal Notice of Petition for Bankruptcy” which you will appreciate is causing me some concern, hence this letter.
The problem is, as I explained when I telephone your office, July 2011, that the debt, if it truly exists and I have my doubts, is not mine. I have never been a guarantor for my son!
I’m also very curious as to why the numerical value of the alleged debt swings so violently, two years ago it was a silly number £1,9758.43 (perhaps a typo error), then it went to £2475.43 and now £1298.95, why?
However, you seem to be persistent with chasing me and maybe in order for the problem to go away I should come to some agreement with you for which I am happy to enter into discussions with you but before this can occur I require the following from you;- A copy of the guarantor agreement that proves that the debt is mine.
- An explanation of why the size of the debt keeps changing?
- The Company Number for NG Collections
- The Consumer Credit License Number for NG Collections
- The Data Protection Registration Number for NG Collections
Also with regard to the Statutory Demand document, you state in the section Particulars of Debt “The Defendant was a guarantor for the tenant” this is actually a fabrication isn’t it? a lie if you want, am I surprised? considering what I know now, not at all!
I await your response however should you be unable to provide the required information then please allow me to suggest for you to go forth and multiply, in old English this means @*%# $@!!

I'm sure sending that letter would give him a boot up the !!!!, although with people like him, I'm not sure it would stop him from pestering.
I'm sure whatever happens to his ailing businesses, he'll manage to scuttle out from under one business name and wriggle under a new one doing the same thing. Which is what he seems to have been doing for the past 10-15 years.
Until the proper authorities take firm legal action against people like this, I think they will unfortunately continue to get away with it.0 -
The legitimacy of the debt aside, students generally sign up with their mates to rent a student house for the academic year. The letting agents that work in the student market generally require a guarantor for each student renting the property. In my experience (second child now at uni), the letting agents are lax at validating the guarantor forms and provided they have a name and address and signature on a piece of paper, the tenancy proceeds.
I did get into conversation with one letting agent about what they do with students who don't have a parent willing or able to act as a guarantor and they told me that telling the student that it is a requirement generally produces the right info, though they have no idea how many signatures are genuine! :eek:
So chances are that you may not be aware that your name has been used to guarantee your son's rent.
That said there may be a lack of understanding on your son's part on either of the following:
a) that he is obliged to pay the rent for the whole length of the tenancy, even if he leaves uni in the middle of the academic year;
b) that him failing to pay the rent will mean that the "guarantor" may be contacted and could be liable.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. Doesn't the fact that NG Collections have no Consumer Credit License completely negate any effort on their part to collect debt under that company name? Does it not also mean that they are committing a criminal offence?0

As I mentioned earlier, my children do stupid things but they are far from stupid and I firmly believe that they would never put my name to a document without my knowledge, they know the difference between right and wrong. To put my name to a document is clearly very wrong .... they know this!
I have just spoken to my son and asked the question did he make me a guarantor for the flat .. absolutely not, the only thing he did was to give a contact address for next of kin.
