    If his "legally trained" wife and his solicitor haven't corrected his assumption that an incorrect amount taken by DD constitutes theft there isn't much hope for any of their advice to be all that useful ;).

    And if your wife is training as a Barrister, then surely you shouldn't need to post on a forum such as this.

    Assumptions - yes! You admitted to them yourself by saying you though everything would be set up ok in the first place without actually checking. And yes, Orange's system doesn't take into consideration interim payments. Whatever it says on the bill to be taken is what it will take.

    As for breach of contract - er no! Mistake - possibly/probably. If it is their fault, then they should reimburse you for any costs including bank charges (if any).

    Just because you don't like what people tell you, doesn't meant they're wrong or not trying to help.

    Just to update you all that doubted it. I have received the money back off orange, and have had my contract terminated without any penalty charges. I am now on PAYG until the s 4 comes out and will be looking into getting that if I likes the looks of it.

    You were lucky. They were not obliged to cancel the contract.

    I agree that if you have incurred any costs that were the fault of Orange then they should reimburse you as i said previously. As I say though you were lucky. Who did you send the phone back to?

    Orange had it back. Now using an iPhone 3 (not the 3g one) for time being

    Even more unusual particularly if you got it through phones 4 u originally but at least you got it sorted.

    All sounds fishy to me and too good to be true

    I suppose the next post a few months from now will be why are debt collectors chasing me for a contract that was cancelled
