I may be wrong but I was under the impression that maintainance would stop if the child was adopted.

    Yes, it would.

If your ex has no parental responsibilities then he cannot stop the adoption without a court order. If you were not married at the time of the babys birth then he does not have parental responsibility (the law onlt changed a few years ago). Check with someone who has legal experience but as far as I know no Parental responsibility= No rights.

    BUT adoption is not simple

The court will ask your local council to provide a report on you, your husband or wife, the child and the birth parents, to help the court make a decision. The report will be prepared by a social worker. The child's other parent(s), holding parental responsibility for them must normally agree to the adoption, although sometimes the court may decide this is not necessary.

You do not need to go though an assessment with an adoption agency when adopting a relative or stepchild who normally lives in the UK. However, the law does require that both you and your husband/wife need to adopt the child, even though one of you is already the child's parent.

I'm guessing that the biological father should still be traced to agree to the adoption, i don't think it's simply a case of oh well he hasn't been on the scence for x amounts of years.

TBH i think as you get child support then he still has ties with his child (does that make sense)

I certainly don't think things are clear cut as many would like to believe, especially regarding his rights etc etc.

(then again i could be uttering a load of nonsense :o )
