Takeaway Rights

If I order a takeaway and the restaurant does not deliver all the items I ordered, what rights do I have? Am I entitled to refuse the order?

    Yes you have the right to refuse the whole order and get a full refund.

    I would argue its a breach of contract and their failure to deliver everything is a fatal breach of the contract.

    You would need to demonstrate somehow that the missing item is important. For example, if they delivered fish and chips without the coca cola can one might argue it is harsh to cancel the whole contract due to a minor item being missing.

    Is the right answer, along with life's too short to cause stress over petty stuff, suck it down, move on and use a different takeaway in future.
