T-Mobile Leaving charges.

Hi folks, asking for a little guidance here chaps and chapesses.

The background info is that I started a T-Mobile contract in February 2011, so my 24 months was to finish on 15/02/13 and I took my PAC on 23/01/13, which I used and transferred to Three on 05/02/13.

My T-Mob plan was £20 p.m with £10 loyalty , when VAT changed , I went to paying £11.17 .

I've posted the numbers from my bill , in the hope that one of you knowledgable souls may be able to tell me whether I'm being had over or not , I have already paid the bill for the 24th month as T-Mob charge in advance , but now they want £13.23 as below .

The MNP and Notice Period Charge stand out .

I hope to get this sorted before the DD can leave my bank, with your help ;)

    The question that comes to mind is why you didn't just wait another 10 days before using your PAC?
    No free lunch, and no free laptop ;)

    What was the billing month pre-paid in Jan?
    Generally, they should have refunded the unused prepaid amount and charged you £11.17 ETC (or £11.17/1.2 if the ETP is VAT excempt).

    No way can it be more than £11.17.

    However, T-mobile are notorious for trying to rob their leaving customers. Under pressure they usually refund the excessive charges:

    Because I was under the impression that I was free to leave them in my final month without picking up further charges, the final months money had been paid.

    Your impression is wrong. You have to give a notice to leave and pay for 30 days after giving the notice even if you leave earlier.

    As T-Mob charge up front , my final month 16 Jan- 15 Feb was rec'd by T-Mob on 31st Jan.
    I would imagine that they could only charge me for the week the week of my 30 day notice from when I took the Pac.

    Nowhere in any T&C's can I find any indication of what the charges are either or how they are arrived at.

    It's the impression they gave me themselves whilst trying negotiate an upgrade , I just don't know which call it was on to refer them back to it.

    I also asked in store yesterday ( told them I was looking to leave , not that I already had) and was told that I would only be charged to the end of my contract date.

    There is no "end of your contract" date.
    It's only the minimum term that ends. If you don't give a notice the contract goes on.
    If you want the contract to end at the end of the minimum term without any extra charges, you have to give the notice 30 days before the minimum term ends.

    However, as I said above, the extra charges that they charged were incorrect. According to their T&C they should have charged you for 16/2-23/2 only, i.e. no more than £2-£3.
  • I'm not 100% sure but I think that the charges (pac debits/etf) are based on your line rental basic charge, so without your loyalty discount.

    Would that make the figures add up?

    Not that I'm saying I agree with it or anything! Just might make it make sense!

    I've just called T-Mob and they are sticking to their guns , I'm being charged for finishing the contract within the 12 months and what sounded like taking the PAC itself.

    I asked for the calculations to be explained to be met with the repetition , also similar to asking where it is explained in the T&C's.

    Your minimum term ended on 15/2, not on the date the final monthly payment was made (a month in advance). So you would incur an ETC in line with the T&C's when your PAC was used prior to 15/2.
    As pointed out above, 30 days notice is still required even if you are out of minimum term. You are then on a contract requiring 30 days notice.
    No free lunch, and no free laptop ;)
